Title:PRAVNA UREDITEV UKREPOV IN DOLŽNOSTI VARNOSTNIKOV

Abstract:Varnost je vrednota, ki pomembno vpliva na kakovost posameznikovega življenja. Za zagotavljanje varnosti je v prvi vrsti zadolžena policija, pomembno vlogo pa igrajo tudi zasebne varnostne organizacije in v okviru njih varnostniki. Varnostniki niso uradne osebe, imajo pa na podlagi zakona pravico izvajati določene ukrepe, ki lahko posegajo v človekove pravice in temeljne svoboščine. Razni tragični primeri iz medijev vedno znova postavljajo pod vprašaj ustreznost pravne ureditve tako ukrepov zasebnih varnostnikov kot tudi dolžnosti, katerih se morajo držati pri opravljanju svojih nalog. Cilj te diplomske naloge je bil ustvariti pregled aktualne pravne ureditve ukrepov in dolžnosti varnostnikov. V ta namen sem proučil relevantne določbe Ustave RS, zakonske ter podzakonske akte in obstoječo literaturo. Na začetku diplomskega dela sem razjasnil določene pojme, ki so pomembni za razumevanje samega področja raziskovanja, nato pa sem na kratko predstavil razvoj pravne ureditve zasebnega varovanja v Republiki Sloveniji od osamosvojitve do sedaj. Potem sem v okviru ukrepov in dolžnosti varnostnikov zaradi lažjega razumevanja povedal najprej nekaj splošnega o pooblastilih. Nato sem se osredotočil na posamezna načela, ki so pomembna za delo varnostnikov. Nadalje sem predstavil dolžnosti, katerih se morajo držati varnostniki pri izvajanju ukrepov, na koncu pa sem obravnaval še posamezne ukrepe varnostnikov.

Title:LEGAL REGULATION OF MEASURES AND DUTIES OF THE SECURITY GUARDS
Abstract:Security is a value that significantly affects the quality of one's life. Although the assurance of security is primarily the duty of police, we can also say that private security organizations and their security guards play an important role in this matter. Security guards are not officials, but they have the right by law to perform certain measures, which may interfere with the human rights and fundamental freedoms. Various tragic examples in media time and again call into question the adequacy of legal regulation as well as the measures of the private security guards as the duties which they need to take into consideration at performing their tasks. The objective of this diploma thesis was to create a review of actual legal regulation of measures and duties of security guards. For this purpose, I studied the relevant articles of Constitution of the Republic of Slovenia, legislative and executive acts, and the existing literature. At the beginning of this work, I explained certain terms which are important for the understanding of the very area of research itself and afterwards I presented in a few words the development of legal regulation of private security in the Republic of Slovenia from the attainment of independence until today. Then, in the context of the measures of security guards, I began by stating some general facts about the authorisations due to the easier understanding. After that I focused on certain principles that are important for the work of security guards. Furthermore, I presented the duties which must be taken into consideration by the security guards at performing their measures and at the end I dealt with the individual measures of the security guards.
