Title:ANALIZA IZOBRAŽEVANJA ZAPOSLENIH V PRAVOSODJU

Abstract:Slovenska sodišča se soočajo z izrazitimi zaostanki. Vse več je afer v zvezi z delom zaposlenih v pravosodnih organih, burne razprave med politiki in v medijih pa le še pripomorejo k temu, da se nezaupanje in nenaklonjenost javnosti pravosodnim organom krepi. Cilj nove politične garniture na področju pravosodja je dvig zaupanja v institucije pravosodnega sistema. To pomeni zagotovitev učinkovitega sodnega sistema, ki zagotavlja pravno varnost državljanom in gospodarskim subjektom in je sposoben učinkovito delovati s preprečevanjem vseh tudi najnevarnejših oblik kriminala in prispevati svoj delež k preprečevanju korupcije. Zato so slovenske oblasti ugotovile, da je nujno, da se zagotovi več izobraževanja in usposabljanja na področju vodenja primerov in splošnega vodenja sodišč. Hitre spremembe notranje zakonodaje, vključno s prenosom evropskega prava v notranje pravo, so povzročile veliko potrebo po izobraževanju in usposabljanju, in to se bo nadaljevalo še dolgo časa, kar se tudi v bodoče kaže kot kontinuiran proces. Dejstvo je, da pravosodni poklic zahteva neprestano izpopolnjevanje v smislu izboljšanja strokovnega znanja ter zahteva znanje tudi drugih veščin, ki so potrebne za izvajanje tega poklica (sposobnost reševanja konfliktov, razvijanje sposobnosti poslušanja nasprotne strani, sposobnost komuniciranja itd…). Le z nenehnim izobraževanjem in usposabljanjem lahko zaposleni v pravosodju dohitevajo razvoj svoje stroke in gredo v korak s splošnim družbenim razvojem. Odgovornost, da zaposleni v pravosodju dobijo znanje, ki ga od njih zahteva sodobni čas, je tako na ravni države, ki mora oblikovati ustrezno zakonodajo in postaviti jasne cilje, kot tudi na ravni sistema izobraževanja ter nenazadnje tudi na ravni Ministrstva za pravosodje, ki skrbi za organizacijo izobraževanj, ki zagotavljajo pravosodnim organom dobro usposobljene in fleksibilne kadre. Zelo pomembno je tudi tesno sodelovanje med nosilci izobraževalnih procesov.

Title:ANALYSIS OF EDUCATION EMPLOYEES IN THE JUDICIARY
Abstract:Slovenian courts of law are facing marked delays in the procedures. All over the affaires in connection with the work of employees in the judiciary as well as heated debate among politicians and the media have a great impact on public distrust and intensity reluctance of the judicial authorities. The aim of renewed political structure is to raise confidence in the institutions of the judicial system. Their goal is ensuring an effective judicial system, which provides legal certainty for all the citizens and is able to work effectively on prevention of the most dangerous forms of crime, including prevention of corruption. Therefore, the Slovenian authorities have found it necessary to provide more education and training in case management and general management of the courts. Fast changes of internal legislation, including the transfer of European law into domestic law, resulted a greater need for education and training. This must be an ongoing process. The fact is that the judicial profession requires continuous education in terms of improving skills and, therefore, an implementation of the profession. This includes many communication skills which, among other things, are of great help at resolving conflicts. Only by continuing education and training can employees in the field of law be able to catch up with the development of their profession, as well as keep up with the general evolution of society. This responsibility should be held both on a national level, in terms of developing appropriate legislation and set out clear objectives, as well as the on level of education of employees themselves. The role of Ministry of Justice is in organizing training courses, the consequence of which is a well-trained and flexible staff. Close cooperation between institutions of educational processes in crucial.
