Abstract:
V nalogi je obravnavan institut jamčevanja za napake gradnje. Naloga temelji na primerjavi med slovensko in angleško pravno ureditvijo ter ureditvijo po mednarodnih pravilih Rdeče knjige FIDIC. Izvajalčeva odgovornost v vseh primerjanih ureditvah izvira iz sklenjene gradbene pogodbe med izvajalcem in naročnikom, vendar pa vsebina in obseg obveznosti izvajalca, oziroma na drugi strani pravic naročnika, ni v vseh treh ureditvah enaka. Slovenski pravni red je del kontinentalnega pravnega reda. Za kontinentalne pravne rede je značilna delitev pogodbenih kršitev na neizpolnitev pogodbe in nepravilno izpolnitev. Stvarne napake po tem sistemu spadajo med nepravilno izpolnitev pogodbe, naročniku pa so na voljo jamčevalni zahtevki pri katerih ima osrednje mesto zahteva po odpravi napake kot posebna vrsta izpolnitvenega zahtevka. Pogoji za uveljavljanje jamčevalnih zahtevkov, vsebina jamčevalnih zahtevkov in njihov obseg so uzakonjeni. V angleški pravni ureditvi je za sankcioniranje pogodbene nediscipline uporabljen drugačen pristop. Ureditev temelji na sistemu enotne kršitve pogodbe. Temeljna in najširše uporabljana sankcija za kršitev pogodbe je plačilo odškodnine. Posebni jamčevalni zahtevek v smislu zahtevka po odpravi napake ni uzakonjen, je pa naročniku dostopen na podlagi pogodbenega sporazuma. Ureditev po pravilih Rdeče knjige FIDIC je kompromis med anglosaksonsko in kontinentalno pravno ureditvijo. Naročniku so ob uporabi Rdeče knjige FIDIC na voljo jamčevalni zahtevki, vključno z zahtevkom za odpravo napake. Kompromis med pravnima ureditvama kot ga predstavljajo pravila Rdeče knjige FIDIC je zlasti v primerih mednarodnih poslov prednost, ker je obema strankama ureditev predvidoma enako poznana.

Contractor's liabilty for building defects
Abstract:
This work deals with liabilty for building defects and compare Slovenian and UK legal regulation and the FIDIC Red Book Rules. In all, the contractors liability has its source in building contract beetwen contractor and employer, but the content of contactor's liabilty, or the employers remedies, are not the same in all three regulations. Slovenial legal system belongs to continental legal systems and distinguishes between non performed contract and incorrectly performed contract. Building with the defect means an inccorect performance of a building contract. The emlployers remedies, conditions for their assertion and their content are determined in law. The primary employer remedy is a demand for repair. The UK law system is based on the system of a integral breach of contract. The main remedy is in paying a damage by a contractor. The employer also has a request for repair, but only if it included in the contract. The FIDIC Red Book Rules are compromise between anglosaxsonic and continental legal systems. Under FIDIC Red Book Rules the employer has a different remedies against contractor who biult the bulding with the defects, also including the request for repair. Using The FIDIC Red Book Rules is advantage for contractual party, particulary in connection with international building contracts, because this arrangements are usually equaly known by both parties.
