Abstract:
V diplomski nalogi so analizirane sinergije med prostim pretokom blaga in varstvom okolja. Varstvo okolja je že dalj časa priznano kot razlog, na podlagi katerega je mogoče opravičiti odstopanja od pravil o prostem pretoku blaga v Evropski uniji, kljub temu da varstvo okolja ni bilo omenjeno v Rimski pogodbi. Precejšen prispevek razvoju prava varstva okolja je dalo Sodišče Evropske unije, ko je varstvo okolja označilo kot bistven cilj Evropske unije ter kasneje jasno izjavilo, da je varstvo okolja ena izmed obveznih zahtev. Kljub temu, da si cilji varstva okolja in prostega pretoka blaga nasprotujejo, v diplomski nalogi dokazujem, da se jih da povezati in uravnotežiti.

Title:
ENVIRONMENTAL PROTECTION AND FREE MOVEMENT OF GOODS IN THE EUROPEAN UNION
Abstract:
The diploma paper discusses synergies between free movement of goods and environmental protection. Environmental protection itself has long been recognised as a justification for derogation from the European Union rules on free movement of goods, despite the fact that it was not mentioned in the Treaty of Rome. The contribution of the Court of European Union to this development was considerable when it ruled, that environmental protection was one of the essential objectives and that it is one of the mandatory requirements. I show that despite the fact, that the objectives of environmental protection oppose the free movement of goods, this two objectives can integrate and balance.
