Abstract:
Hiter enostranski razvoj gospodarstva zasnovan na neoliberalnem modelu kapitalizma, negativni učinki globalizacije ter prisotna gospodarska in socialna kriza ponovno zbujajo upravičeni interes za etiko in moralo. Tehnološki napredek je dal človeku izredno moč kateri etična odgovornost ne sledi. Človeštvo se nahaja v moralni krizi, ki je ne bo mogoče razrešiti samo na trgu in z ekonomskim pristopom k razvoju družbe. V tržnem gospodarstvu gospodarske družbe uporabljajo različna pravila urejanja medsebojni odnosov. Tu mislim na pravna, družbeno politična, moralna in običajna pravila. V nalogi sem se osredotočila predvsem na vlogo morale in etike kot nadgradnje prava pri urejanju medsebojnih odnosov. Glede na to da v strokovni literaturi ni enotnega pojmovanja morale, etike ter prava, sem moralo pojmovala kot skupek vrednot, ki odražajo osebno in družbeno zavest ter opredeljujejo kaj je za človeka dobro in kaj slabo, kaj človeško in kaj nehumano. Na osnovi teh vrednot izreka morala vrednostne sodbe s katerimi ocenjuje človekovo ravnanje kot dobro ali slabo. Etika kot filozofija morale naj bi vsebovala želene idealne norme obnašanja ljudi. Moralne norme so odvisne od stopnje družbeno gospodarskega razvoja in kulture oziroma kraja kjer nastanejo. Pravo kot minimum morale je praviloma kodificirano, pravice in dolžnosti pravnih subjektov so vnaprej določene ali vsaj določljive. S pravom se zagotavlja pravna varnost oziroma se varuje posameznik pred škodljivimi dejanji drugega. Večjo kvaliteto življenja in odnosov z drugimi zagotavljajo moralne norme. Na področju gospodarskih odnosov sta si pravo in etika komplementarna kar pomeni da se pri zasledovanju istega cilja dopolnjujeta. Poslovna morala se pojavlja na višji stopnji gospodarskega razvoja ko prihaja do večje delitve dela in se gospodarski tokovi ločujejo od splošno družbenih. Poslovna morala kot del družbene nadgradnje oziroma družbene zavesti je usmerjena na gospodarsko področje s ciljem uveljavljanja načel humanizma in moralnih vrednot. Poslovna etika naj bi izražala želeno idealno stanje na področju stvarnega poslovanja z vidika najvišjih standardov poštenja, pravičnosti in dobrega. Poslovna etika je v današnjem času globalizacije in internacionalizacije gospodarskih odnosov nujni temelj urejanja ali regulative poslovnih odnosov med gospodarskimi subjekti glede na to da so pravna pravila različna in predstavljajo minimum možnega urejanja. Poslovna etika se konkretizira preko etičnih kodeksov in priporočil, ki usmerjajo udeležence v poslovanju z vidika poštenosti, humanosti, pravičnosti in medsebojnega spoštovanja. Za urejanje odnosov med gospodarskimi družbami imajo pomembno vlogo dobri poslovni običaji, ki se izražajo kot standardi poslovne morale in pomemben element poslovne etike. Za kršitve dobrih poslovnih običajev in utrjevanje poslovne morale deluje pri Gospodarski zbornici Slovenije Častno sodišče, ki izreka tudi ukrepe kršiteljem.

THE ROLE OF BUSINESS ETHICS AND CORPORATE SOCIAL RESPONSIBILITY IN ECONOMIC PRACTICE
Abstract:
Rapid one-sided development of economics based on neo-liberal model of capitalism, negative side effects of globalisation and accompanying economical and social crisis are the factors that awake justifiable interests for ethics and morale. Technological progress enabled the man to use the immense power and therefore the ethical responsibility cannot keep up with it. The humanity found itself in the middle of the morale crisis, which will be impossible to resolve only through business market and by economic approach to development of the society. In market economics corporate associations employ various rules for arranging the reciprocal relations. These rules are legal, corporate political, moral and also general. In this thesis I have focused my attention especially on the role of the morale and ethics representing the upgrade of law in managing the reciprocal relations. Taking into account that in expert literature there is no unified comprehension of morale, ethics and law, I have defined the morale as the collection of values that reflect personal and corporate consciousness and at the same time define what is good and bad, humane and inhumane for all human beings. On the basis of these values the morale declares valuable judgements with which it evaluates the human conduct as good or bad. Ethics, as the philosophy of morale, should comprise the desired ideal norms of human behaviour. Morale norms are dependent on the level of the social and economic development and also on the culture or the place where they arise. Law, as the minimum of the morale, is usually codified; the rights and obligations of legal subjects are defined in advance or are at least definable. Law enables legal safety and it also protects the individual against the harmful actions of others. The morale norms ensure the greater quality of life and reciprocal relationships. In the sphere of economic relations the law and the ethics come hand in hand, which means that in the pursuit of the same goal they are complementary. Business morale appears on a higher level of economic development when it comes to a greater division of labour and also when the economic streams are separated from the social ones. Business morale as a part of the social upgrade or social consciousness is oriented towards the economic sphere with the goal to enforce the principles of humanism and morale values. The business ethics should express the desired situation in the sphere of real economic operations, considering the highest standards of honesty, justness and common good. In today’s time of globalisation and internationalisation of economic relations, the business ethics is the necessary foundation of regulating the business relations among economic subjects, especially because of the various legal rules which represent the minimum of regulation. Business ethics is concretized through codes of ethics and recommendations, which guide the participants in economic operations, also considering the principles of honesty, humanity, justness and mutual respect. For regulation of relations among companies it is important to respect the fair commercial practice, which is expressed as a standard of business moral and also as an important element of business ethics. For violation of fair commercial practice and also for reinforcement of business morale, there is the Court of Honour, which operates within the frame of Chamber of Commerce and Industry of Slovenia, which acts against all the violators.
