Title:Ureditev prestopov športnikov in druge aktualne dileme športnega prava : magistrsko delo

Abstract:Magistrsko delo predstavlja aktualne dileme športnega prava in dileme prestopov športnikov, s poudarkom na prestopih poklicnih nogometnih igralcev. S predstavitvijo razmerja med pravom in športom se spozna, da pravo posega tudi na področje športa. Pravna pravila, ki urejajo šport, se delijo v tri skupine. Prva skupina vključuje državna in naddržavna pravila, ki posredno posegajo na področje športa, druga skupina zajema specifična pravila, ki se nanašajo izključno na šport, tretja skupina pa obsega avtonomna pravila športnih organizacij. Športne organizacije delujejo z določeno stopnjo avtonomije, vendar so hkrati vezane na kriterije in okvirje, ki jih vzpostavljajo državna pravila in pravo Evropske unije. Evropska unija je ena od deležnikov, ki se v vedno večji meri vključuje v športno področje. Njene institucije in organi so izdali številne delovne načrte in priporočila, kako naj države članice aktivno sodelujejo v športu in izvajajo športno politiko. Skozi sodno prakso Sodišča Evropske unije se krepi vloga športa v pravnem sistemu Evropske unije. V šport posegajo predvsem pravila notranjega trga Evropske unije, ki zadevajo zlasti problematiko prestopov športnikov. Kot delavci imajo poklicni športniki možnost svobodne izbire, s katerim delodajalcem bodo sklenili pogodbo o zaposlitvi – v tem primeru so delodajalci športni klubi. Vendar se kljub tej svobodi pogosto srečujejo z ovirami in omejitvami, ki jim onemogočajo ali otežujejo prosto prestopanje med klubi. To predstavlja izzive pri uresničevanju prostega gibanja delavcev v luči prava Evropske unije. Največja pozornost se pri prestopu športnikov namenja v športni panogi nogomet. Nogomet kot novodobna gospodarska veja industrije predstavlja vrhunski profesionalni šport. Posledično je njegov status vplival na ustanovitev pomembne mednarodne nogometne organizacije FIFA, ki ima vpliv na celotno ureditev nogometa, tako s športnega kot tudi pravnega vidika. FIFA je društvo, urejeno po švicarskem pravu, ki skrbi za razvoj nogometa po svetu in ima svoje organe, svoje predpise in svoja pravna pravila. Razdeljeno je na konfederacije, ki se nadalje delijo na nacionalne nogometne zveze. Kljub relativni samostojnosti ima FIFA pravilnik, ki sistematično ureja problematiko mednarodnih prestopov poklicnih igralcev iz kluba ene države v klub druge države. Prestopi sodijo med kompleksne procese, ki vključujejo različne udeležence in v Evropski uniji pogosto predstavljajo problem zaradi morebitnih kršitev notranjega prava Evropske unije. Zaradi specifične narave športa se mora tudi reševanje športnih sporov prilagoditi posebnostim iz področja športa. S tem namenom je bilo ustanovljeno Arbitražno sodišče za šport – CAS.

Title:Regulation of athletes transfers and other current dilemmas in sports law
Abstract:The master's thesis addresses current dilemmas in sports law and athlete transfer issues, with a focus on the transfers of professional football players. Legal rules governing sports can be divided into three groups. The first group includes state and supranational rules that indirectly impact the field of sports. The second group encompasses specific rules exclusively related to sports, while the third group consists of autonomous rules of sports organizations. Sports organizations operate with a certain degree of autonomy but are simultaneously bound by criteria and frameworks established by state rules and European Union law. The European Union is increasingly involved in the field of sports. Its institutions and bodies have issued extensive plans and recommendations on how member states should actively participate in sports and implement sports policies. Through the judicial practices of the European Court of Justice, the role of sports in the legal system of the European Union is reinforced. Internal market rules of the European Union, particularly those concerning athlete transfers, significantly impact sports. As workers, professional athletes have the freedom to choose which employers to enter into employment contracts with – in this case, sports clubs. However, despite this freedom, they often face obstacles and limitations that hinder or complicate free movement between clubs. This poses challenges to the realization of the free movement of workers within the framework of European Union law. Athlete transfers receive the most attention in the football industry. Football, as a modern economic branch of the industry, represents a top-tier professional sport. As a result, the significant international football organization FIFA was established, influencing the entire regulation of football from both a sports and legal perspective. FIFA, a Swiss law association, is responsible for the global development of football and has its own organs, regulations, and legal rules. It is divided into confederations, which further divide into national football associations. Despite its relative autonomy, FIFA has regulations systematically addressing the issue of international transfers of professional players from one country's club to another. Transfers are, therefore, a complex process involving various stakeholders and often present a core problem in the European Union due to potential violations of internal EU law. Due to the specific nature of sports, the resolution of sports disputes must adapt to the unique characteristics of the sports sector. For this purpose, the Court of Arbitration for Sport (CAS) was established.
