Title:Pravica delavca do odklopa : magistrsko delo

Abstract:Razvoj informacijske in komunikacijske tehnologije ima velik vpliv na življenja vseh posameznikov, prav tako pa tudi na področje delovnega prava. Vsak posameznik je z razvojem tehnologije pridobil možnost, da ima kjerkoli in kadarkoli pri roki napravo, ki mu omogoča, da je vsakomur dosegljiv. To se odraža tudi na področju delovnega prava, in sicer na način, da delodajalci kontaktirajo delavce, ne le v času rednih delovnih ur, temveč tudi izven delovnega časa. Kontaktirajo jih lahko tudi sodelavci, z vprašanji v zvezi z delom. Delavci pa so velikokrat primorani na te klice ali sporočila odgovoriti, saj se bojijo izgube zaposlitve ali pa imajo naloženo delo, ki ga v rednem delovnem času niso morali opraviti. Pri tem nastaja težava v zvezi z dosegljivostjo delavcev, saj to pomeni, da delavci delo opravljajo brez možnosti za počitek oziroma svojega prostega časa ne izkoriščajo na način, kot bi si ga sami želeli. S tem razlogom se je razvila pravica do odklopa, in sicer pravica delavca, da se ne odziva na klice in sporočila delodajalca ter obveznosti delodajalcev, da delavcev ne kontaktirajo izven rednih delovnih ur. Pri tem so pomembna vsa pravila v zvezi z delovnim časom, dnevnim in tedenskim počitkom ter odmori, kateri so zajeti v mednarodnem, evropskem in nacionalnem pravu. Z dosledno uporabo vseh teh pravil se delavcem daje pravica do počitka. Kljub vsem obstoječim pravilom pa se je razvila posebna pravica, to je pravica do odklopa, ki ni le pravica delavcev, temveč tudi obveznost delodajalcev, ki jo je potrebno uzakoniti, saj obstoječa pravila v zvezi z delovnim časom, počitki in odmorom, ne zadostujejo. Potrebna so torej posebna pravna pravila, ki bodo delavcem dala pravico, da se odmakne od delovnega okolja in čas preživi po lastni volji. Pomembnost te pravice se kaže v tem, da se vedno več držav odloča za uzakonitev pravice do odklopa, od katerih je bila prva država Francija, kateri so sledile tudi druge. Tudi Slovenija je sprejela predlog spremembe ZDR-1, kjer bi poseben člen uredil pravico do odklopa ter sankcije v primeru nesprejema ukrepov za uveljavitev pravice do odklopa. Prav tako na ravni Evropske unije potekajo aktivnosti za uzakonitev pravice do odklopa, saj je bila sprejeta Resolucija Evropskega parlamenta s predlogom morebitne nove direktive o pravici do odklopa, ki bi harmonizirala ureditev v vseh državah članicah.

Title:The Right to Disconnect
Abstract:The development of information and communications technology has a significant impact on the lives of everyone as well as the field of labour law. With information and communications technology every individual has gained the ability to have a device at their disposal, allowing them to be reachable anytime and anywhere. This also reflects in the field of labour law in a way that employers contact employees not only during regular working hours but also outside working time. Also, coworkers can contact each other’s outside working time with work related questions. Employees often feel compelled to respond to these calls or messages due to fear of losing their job or because they have work assigned to them that they could not complete during working time. With this situation comes an issue of the availability of employees which means they work without opportunity for rest or utilizing their free time as they would prefer. For this reason, the right to disconnect has developed, which is the right of an employee not to respond to calls and messages from the employer, and it is also an obligation of the employer not to contact employees outside of working time. All rules regarding the working time, daily and weekly rest, and breaks are essential, as they are covered by international, European, and national laws. With consistent use of these rules, employees are given the right to rest. However, despite existing rules, a special right has emerged – the right to disconnect. This is not only the right of an employee, but also the obligation of an employer that needs to be legislated, because the existing rules of working time, rest and break are not sufficient. Therefore, special legal rules are required to give workers the opportunity to detach from work environment and spend their free time as they choose. The importance of this right is shown in the fact that an increased number of countries are opting to legislate the right to disconnect, with France being the first country to do so, followed by others. Slovenia also adopted the proposal to amend labour law that would regulate the right to disconnect and sanctions for non-acceptance of measures for the right to disconnect. At the European union level activities are also underway to legislate this right, as European Parliament adopted a resolution with a potential directive on the right to disconnect, which would harmonize regulations across all member states.
