Title:Povezane nepremičnine in etažna lastnina : magistrsko delo

Abstract:Magistrska naloga z naslovom »Povezane nepremičnine in etažna lastnina« je namenjana predvsem celoviti in pravilni predstavitvi zakonske interpretacije določb instituta povezanih nepremičnin, ki predstavlja eno izmed najpomembnejših novosti novele SPZ-B iz leta 2020. Že v času pred začetkom veljavnosti SPZ in ZZK-1 so se kot eden izmed načinov gradnje, pojavljale soseske enostanovanjskih hiš, soseske več večstanovanjskih stavb in soseske enostanovanjskih hiš in več večstanovanjskih stavb. Nekateri pravni položaji znotraj teh sosesk, ki so po svoji funkcionalnosti imeli značilnosti etažne lastnine, vendar glede na svoj osnovni pravni položaj to niso, v takratni zakonodaji na stvarnopravnem področju niso imeli primernih zakonskih rešitev. Vzpostavitev je tako bila mogoča ob uporabi nekaterih institutov stvarnega prava, ki pa za to niso bili najbolj primerni oziroma primarno sploh niso bili temu namenjeni. Ob vse hitrejšem naraščanju števila gradnje novih sosesk v zadnjih letih, je bil tudi zakonodajalec primoran poiskati nove rešitve za zagotovitev primernejšega in bolj učinkovitega reševanja položajev tako na področju etažne lastnine kot na področju položajev podobnih etažni lastnini. Institut povezanih nepremičnin, urejen v novem, V. poglavju SPZ, tako ureja etažni lastnini podobne položaje tako, da tudi v primerih, kjer ni vzpostavljene etažne lastnine, omogoča vključitev lastninske pravice ali stavbne pravice na nepremičnini imenovani pomožna nepremičnina, v lastninsko pravico ali stavbno pravico ene ali več drugih nepremičnin, imenovanih glavne nepremičnine. Novo poglavje o povezanih nepremičninah tako določa pravila o nastanku, upravljanju ter prenehanju povezanosti med nepremičninami. Hkrati z institutom povezanih nepremičnin pa je kot del novele SPZ-B bil dodan tudi novi šesti odstavek 105. člena SPZ, ki ob uporabi pravil o oblikovanju, upravljanju in prenehanju povezanih nepremičnin, omogoča vzpostavitev položaja v katerem lahko ima posamezni del zgradbe ali nepremičnina hkrati značilnosti pomožne nepremičnine in skupnega dela stavbe v etažni lastnini. Ureditev novega instituta povezanih nepremičnin tako v osnovni predstavlja dobre temelje za njen nadaljnji razvoj tega instituta, kljub temu, da bo potrebno določene nepravilnosti odpraviti in pomanjkljivosti dopolniti.

Title:Linked immovable properties and commonhold
Abstract:The Master's thesis entitled "Linked immovable properties and commonhold" is aimed at primarily presenting a comprehensive and correct legal interpretation of the provisions of the concept of linked immovable property, which is one of the most important novelties of the 2020 amendment to the SPZ-B. Already in the period before the SPZ and ZZK-1 came into force, the following were considered as one of the construction methods, neighborhoods of single-family houses, neighborhoods of multi multi-apartment buildings, neighborhoods of single-family houses and multi-apartment buildings. Some of the legal situations within these were functional in nature but had the characteristics of commonhold, but which, by virtue of their basic legal status, did not have the same property law status at the time adequate legal solutions. The establishment was therefore possible by applying certain institutes of property law, which were not the most appropriate or even the primary ones for this purpose intended. In the context of the accelerating growth in the construction of new neighborhoods in recent years, the legislator has also had to find new solutions to ensure a more appropriate and more efficient way of dealing with the situation both in the area of commonhold and in the area of similar to commonhold. The institution of linked immovable property, regulated in the new Chapter V of the SPZ, thus regulates the situation of the ownership of a commonhold in such a way that, even in cases where there is no established inclusion of a property right or a building right in the immovable property called ancillary immovable property, into the ownership or building right of one or more other immovable property, known as the main immovable property. The new chapter on linked immovable property thus lays down the rules on the creation, management, and termination of a link between immovable properties. At the same time as the institution of linked immovable property, as part of the amendment to the SPZ-B, a new sixth paragraph of Article 105 of the SPZ was added as part of the new SPZ-B, which, while applying the rules on formation, management, and termination of linked immovable property, allows for the creation of a situation in which a particular part of a building or immovable property may at the same time have the characteristics of ancillary immovable property and the common part of the building in the commonhold. The new regime, although basic, represents a good basis for the further development of this institution, although certain anomalies will have to be corrected and shortcomings to be filled in.
