Title:Vloga policijskega starešine v postopkih uporabe prisilnih sredstev : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Namen diplomskega dela je opozoriti na napake v sistemu, ki policista v postopkih uporabe prisilnih sredstev postavljajo v izredno težki položaj. Policist je tisti, ki je največkrat poklican na kraj, ko se konfliktna situacije ne more več rešiti brez tretje osebe. Policist mora v dani situaciji pravilno presoditi in ovrednotiti položaj. Policist se mora pravilno odločiti in uporabiti prisilna sredstva na način, kot je določeno v zakonu in podzakonskih predpisih. Ob vsaki uporabi prisilnih sredstev policijski starešina preveri, strokovnost in zakonitost uporabe prisilnih sredstev. Ta ocena je v postopkih, ki sledijo še kako pomembna, saj je od nje odvisno nadaljnje postopanje zoper policista. Najprej se bomo osredotočili na zakonodajo in v tem okviru bomo predstavili zakonske omejitve prisilnih sredstev, predstavili bomo pogoje, v katerih se lahko uporabijo prisilna sredstva, katera prisilna sredstva poznamo in načela, ki jih moramo upoštevati ob uporabi prisilnih sredstev. V nadaljevanju se bomo posvetili vplivu in lastnostim dobrega vode. Razložili bomo pomembnost vodje, kakšne so značilnosti uspešnega vodje, kakšna je formalna in socialna moč vodenja ter katere stile vodenja poznamo. Da si sploh lahko ustvarimo sliko, je potrebno pojasniti še oblike in načine nadzora nad delom policije. Predstavljen bo statistični pregled uporabe prisilnih sredstev, kjer bomo izpostavili primere, ki so bili ocenjeni zakonito in nestrokovno ali nezakonito in nestrokovno. Rezultate bomo v nadaljevanju primerjali z uporabo prisilnih sredstev na Policijski upravi Maribor v enakem obdobju in z enakimi predpostavkami. Vse te raziskave bomo v nadaljevanju povezali v teoretičnem primeru, kjer bo predstavljeno, zakaj so zgoraj naštete dobrine pri policijski starešini, ki ocenjuje uporabo prisilnih sredstev, tako pomembne. Predstavljene bodo negativne posledice, ki padejo izključno na policista in postopki, ki sledijo policistu. Diplomsko delo, katerega namen je izpostaviti sistemsko napako, bomo zaključili z interpretacijo zastavljenih hipotez.

Title:The role of the senior police officer in the procedure regarding the use of force weapons and tools
Abstract:The purpose of the diploma thesis is to draw attention to errors in the system which put police officers in an extremely difficult position when use of force weapons and tools is implemented. It is the police officer who is most often called to a scene where conflict situations can no longer be resolved without a third party. Consequently, the police officer must properly assess and evaluate the situation in question. The police officer must make the right decision and use weapons and tools regarding use of force in the manner laid down in the law and bylaws. Each time the use of force weapons and tools is used, the senior police officer verifies competence and legality of the use of force tools and weapons. This assessment is particularly important in the proceedings that follow, as it is dependent on further actions against the police officer. First, I will focus on legislation and, in this context, present the legal restrictions of use of force tools and weapons, I will present the conditions under which use of force tools and weapons can be used, what use of force tools and weapons we know and the principles we must follow when using them. Furthermore, I will shed light on the influence and qualities of a good police leader. I will explain the leader's importance, which personal traits a successful leader has, what formal and social power of leadership is, and what leadership styles we know. To comprehend the matter discussed, it is necessary to clarify the forms and methods of policing. A statistical review of the use of force will be presented, highlighting cases that have been assessed lawfully and incompetently or unlawfully and incompetently. Moreover, the results will be compared with the use of force tools and weapons used at the Maribor Police Directorate during the same period and presumptions. All parts of the research will be holistically presented in a theoretical case, which will show why the above-mentioned good personal traits and attributes of the senior police officer who assesses the use of force tools and weapons used are so important. I will also present negative consequences which a police officer faces and the procedures that follow. To conclude the thesis which aims to highlight the systemic error in question, I will interpret the set hypotheses.
