Title:Procesne napake policistov v predkazenskem postopku in ekskluzija dokazov : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V diplomski nalogi je predstavljen kazenski postopek v Sloveniji z osredotočenostjo na pooblastila policistov v predkazenskem postopku ter ekskluzijo dokazov kot posledico njihovega kršenja. Institut izločitve dokazov preprečuje, da bi država zoper obdolženega uporabila dokaze, ki so bili zbrani na nezakonit način, torej s kršitvijo temeljnih človekovih pravic. Institut je uveljavljen tudi v slovenskem pravnem sistemu, ki temelji na mešanem tipu kazenskega postopka. Slednji združuje cilja akuzatornega in inkvizitornega postopka, ki si med seboj nasprotujeta. Ekskluzija, ki je tipičen akuzatorni institut, tako nasprotuje načelu iskanja materialne resnice, značilne za inkvizitorni postopek, njuna nezdružljivost pa omogoča, da so zaradi napak policistov oproščene osebe, ki so verjetni storilci kaznivega dejanja. Slednje lahko pripišemo tudi pojmovanju ekskluzije, vzpostavljenemu v Sloveniji. Naš sistem namreč vztraja pri absolutizaciji ekskluzije, ki za razliko od utilitaristične ureditve ne dopušča tehtanja med smiselnostjo izločitve dokazov in pomembnostjo dokaza za kazenski postopek. To pomeni, da so dokazi, pridobljeni s kršenjem pravnih pravil, v vsakem primeru predmet izločitve. Prav zaradi tega je delo policistov izjemno pomembno, saj s preiskovalnimi dejanji močno posegajo v zasebnost posameznika in je pravilno izvajanje slednjih ključnega pomena za uspešnost kazenskega postopka.

Title:Police procedural mistakes in pre-trial prejudice and the exclusionary rule
Abstract:The diploma thesis presents criminal proceedings in Slovenia with a focus on the powers of police officers in pre-trial proceedings and the exclusionary rule as a result of their violation. The institution of exclusion of evidence prevents the state from using evidence against the accused, which was collected in an illegal manner, i.e. by violating fundamental human rights. The institution is also established in the Slovenian legal system, which is based on a mixed type of criminal proceedings. The latter combines the objectives of the accusatory and inquisitorial proceedings, which contradict each other. Exclusion, which is a typical accusatory institution, thus contradicts the principle of searching for the material truth, characteristic of the inquisitorial proceedings, and their incompatibility allows persons who are probable perpetrators of a crime to be acquitted due to procedural errors of police officers. The latter can also be attributed to the conception of exclusion, established in Slovenia. Namely, our system insists on the absolutisation of exclusion, which does not allow a balance between the reasonableness of excluding evidence and the importance of evidence for criminal proceedings. This means that evidence obtained by the violation of legal rules is always subject to exclusion. This is why the work of police officers is very important, as investigative actions strongly infringe on the privacy of the individual and the proper implementation of the latter is crucial for the success of criminal proceedings.
