Abstract:
V magistrskem delu je obravnavana tema oblikovanje tožbenih zahtevkov v delovnopravnem področju. Sistematično je zajeta delovnopravna zakonodaja, predvsem uporaba Zakona o delovnih razmerjih ob subsidiarni uporabi Zakona o delovnih in socialnih sodiščih ter Zakona o pravdnem postopku. Vsebina magistrske naloge v celoti opredeljuje individualne delovne spore ter kolektivno tožbo. Predvsem se nanaša na oblikovanje tožbenih zahtevkov, ki so tako v praksi kot v teoriji jedro same tožbe ter opredeljuje različne možnosti delavca v predsodnem in sodnem postopku. S pomočjo sodne prakse različno stopenjskih sodišč, nacionalne zakonodaje ter raznih strokovnih člankov in knjig se spoznamo s primerno oblikovanimi tožbenimi zahtevki postavljenimi s strani pooblaščenca tožnika in navsezadnje z samim delovanjem slovenskega sodstva. S predmetnim magistrskim delom je prikazano celovito varstvo tožnika, ki zajema krajšo predstavitev dejanskega stanja, ki se nadaljuje z predstavijo različnih možnosti, ki jih ima delavec v predsodnem postopku ter zaključi z vložitvijo tožbe na pristojno delovno sodišče. Nadaljnje je kot novost predstavljen tudi Zakon o kolektivnih tožbah, za katerega lahko predvidevam, da bo na delovnopravno področje vpeljal veliko sprememb in novitet, vendar sodna praksa na to temo še ne obstaja. V magistrskem delu sem preučila zakonsko ureditev oblikovanja tožbenih zahtevkov v individualnih delovnih sporih ter med souporabo sodne prakse izpostavila najpomembnejša zakonska določila in ustrezno uporabo zakonskih predpisov.

Title:
Forming of statements of claim in individual labour disputes
Abstract:
The topic of the master's thesis is the formulation of statements of claim in the field of labour law. Labour legislation is systematically covered, in particular, the application of the Employment Relationships Act, with the subsidiary application of the Labour and Social Courts Act and the Code of Civil Procedure. The content of the master's thesis defines individual labour disputes and a collective lawsuit. In particular, it refers to the formulation of lawsuits which, both in practice and in theory, are the core of the lawsuit itself, and defines the various options of a worker in pre-trial and judicial proceedings. With the help of the case law of courts of the same level and type, national legislation and various professional articles and books, we are acquainted with properly formed statements of claim, filed by the plaintiff's authorized representative and, ultimately, the very functioning of the Slovenian judiciary. As the subject of the master's thesis, the full protection of the plaintiff is presented. It includes a short introduction to the facts of the dispute, which continues with the presentation of various possibilities that the worker has in the pre-trial process and ends with the filing of the lawsuit to the competent labour court. Further, as a novelty, the Collective Actions Act is presented, which I assume will introduce a lot of changes and innovations in the field of labour law, but the case law on this subject does not yet exist. In the master's thesis, I examined the legal regulation of the formulation of claims in individual labour disputes and during the application of case-law highlighted the most important legal provisions and the proper application of legal regulations.
