Title:ZAŠČITA AVTORJEV V SISTEMU KOLEKTIVNEGA UPRAVLJANJA AVTORSKIH PRAVIC

Abstract:Izkušnje v zadnjih letih vse bolj potrjujejo, da je individualno upravljanje avtorskih pravic nepraktično v primerih, kjer uporabniki potrebujejo hiter dostop do velikega števila del. Hiter gospodarski razvoj in povečanje trgovinske menjave, ki ga poganja v glavnem tehnološki napredek in spremljajoča rast uporabe zaščitenih del, še posebej v digitalnem okolju, je uvrstila kolektivno upravljanje avtorskih pravic na osrednje mesto zaščite pravic avtorjev. Prvi del diplomske naloge obravnava opredelitev in različne načine kolektivnega upravljanja avtorskih pravic. Poudarjen je izjemen pomen slednjih v razvijajočih in tranzicijskih državah, kot je Slovenija, kjer je infrastruktura v domeni avtorskih pravic še vedno v relativno zgodnji fazi razvoja. V drugem delu diplomske naloge je obravnavan Predlog Zakona o kolektivnem upravljanju avtorske in sorodnih pravic, ki v slovenski pravni red prenaša Direktivo 2014/26/EU. Problem obstoječe regulative je v dejstvu, da le-ta ni uspela zagotoviti ciljev, kot so večja vključenost imetnikov pravic v sprejemanje ključnih odločitev kolektivnih organizacij, večja preglednost delovanja kolektivnih organizacij in učinkovitejši nadzor na delovanjem kolektivnih organizacij in uporabnikov avtorskih del. Ugotavlja se, da Predlog ZKUASP kljub kritiki dobro odraža razvoj na področju avtorske in sorodnih pravic, potrebna pa bo natančna ureditev določb obveznosti kolektivnih organizacij in kakovostnega nadzora nad delovanjem le-teh.

Title:PROTECTION OF AUTHORS IN THE SYSTEM OF COLLECTIVE MANAGEMENT OF COPYRIGHTS
Abstract:The experience of recent years has increasingly confirmed that the individual exercise of rights is impractical in cases where users need rapid access to large number of works. The increased economic development and trade relations, driven largely by technological advancement and the attendant rise in the use of protected works, particulary in the digital environment has put collective management of copyrights at the centre position of rights protection for authors. The first part of the project discusses the definition and various ways of collective management of copyrights. We stress its utmost importance in developing and transition economies, like Slovenia, where the copyright infrastructure is still in a relatively early stage of development. In the second part of our project we adress out intention to the bill on collective management of copyright and related rights, which implements the Directive 2014/26/EU in the Slovenian law. The problem of existing regulation is the fact that the latter failed to ensure goals such as greater involvement of the holders of the rights to the adoption of key decisions of collecting societies, greater transparency in the operation of collective societies and efficient control of the operation of collecting societies and users of copyright works. We find that this legislation, despite some critics, has been developed very carefully to reflect the development in the field of copyright and related rights, but requires precise arrangement of the obligations of collecting societies and good control of their operations.
