Title:NADOMEŠČANJE SAMOZAPOSLENEGA MED DALJŠO ODSOTNOSTJO

Abstract:Zaposlovanje novih kadrov za določen čas, ko gre za nadomeščanje odsotnega delavca, je ustaljena in pogosta praksa. Nadomeščanje samozaposlenega, ki je hkrati tudi edini zaposleni, pa predstavlja večji izziv. Zakonske možnosti za nadomeščanje samozaposlenega, poleg sklenitve delovnega razmerja za določen čas, dopuščajo tudi druge oblike delovnih razmerij (zaposlitev s krajšim delovnim časom, zaposlitev na domu, agencijsko zaposlovanje), sklepanje podjemne pogodbe, avtorski honorar, pogodbo o poslovnem sodelovanju, študentsko delo, pomoč družinskega člana in volonterstvo. Glede na to, da začetek daljše odsotnosti podjetnika, posebej v primeru, ko je le-ta edini zaposleni, predstavlja stresno situacijo že samo po sebi, je to hkrati tudi čas, ko je treba sprejeti poslovno odločitev, kako poslovati do konca odsotnosti. Podjetnik se mora odločiti, ali bo v času njegove odsotnosti podjetje poslovalo v enakem ali zmanjšanem obsegu ali pa bo zgolj dokončalo začeti projekt. Za samostojnega podjetnika je zato pomembno, da pozna oziroma dobi informacije o možnostih nadomeščanja, ki so primerne zanj, glede na položaj, naravo dela, finančna sredstva in druge dejavnike, saj bo le tako lahko sprejemal prave in zakonsko skladne odločitve.

Title:SUBSTITUTING THE SELF-EMPLOYED DURING THE LONG LEAVE OF ABSENCE
Abstract:Employing new personnel for a determinate period of time to fill in for an employee on a leave is a common practice. Substituting a self-employed who is at the same time the only employee presents however a bigger challenge. Beside an employment for a determinate period of time, the statutory law for substituting a self-employed for a determinate period of time offers a wide variety of different types of employment (short-time employment, work from home employment, employment over agencies), such as signing a work contract, royalty payments, a business contract, student work, help of a family member and volunteer work. Considering that the start of a self-employed's longer absence from work represents a stressful situation, especially when he/she is the only employee, this is the time to make a decision on how to conduct business until in the meantime. The self-employed has to decide whether to operate as before or to reduce the scope of work while his/hers absence. Therefore it is essential for the self-employed to know or be informed about the possibilities of substituting that suits their line of work, financial situation and other variable factors to make the right and legally compliant decisions.
