Abstract:
Pričujoče diplomsko delo obravnava pravni okvir človekovih pravic. Človekove pravice so nedvomno ena največjih in najpomembnejših dosežkov moderne dobe. Prvič v zgodovini človeštva je posamezniku zagotovljeno jamstvo za dostojno življenje v svobodi, pravičnosti in miru. Pravna ureditev in pravno varstvo človekovih pravic sta postala odgovornost vsake posamezne države in mednarodne skupnosti. Tako so človekove pravice postale univerzalne in danes veljajo povsod in za vsakogar. Diplomsko delo tako na začetku prikazuje razvoj človekovih pravic skozi ključne zgodovinske dogodke in pravne dokumente, ki so prispevali k nastanku človekovih pravic, kot jih poznamo danes. Upoštevajoč različna pojmovanja človekovih pravic diplomsko delo v opisuje človekove pravice, kot izhaja iz MLČP. Posebna pozornost je namenjena glavnemu poglavju, in sicer pravnemu okvirju človekovih pravic, pri čemer diplomsko delo primarno izhaja iz mednarodnega prava človekovih pravic in ga dopolnjuje z mednarodno-regionalnim in nacionalnim pravom. V nadaljevanju tako predstavlja MLČP in preostalih sedem ključnih mednarodnih dokumentov, ki pokrivajo različna področja človekovih pravic: državljanske in politične pravice, ekonomske, socialne in kulturne pravice, rasno diskriminacijo, diskriminacijo žensk, mučenje, otroke, delavce migrante in člane njihovih družin, prisilna izginotja in invalide. Diplomsko delo se sklene z opisom nadzornih mehanizmov, ki bdijo nad uresničevanjem človekovih pravic in opisov institutov, ki so na voljo posamezniku, ki jih lahko uporabi v primeru, ko meni, da so mu kršene človekove pravice.

LEGAL FRAMEWORK ON HUMAN RIGHTS
Abstract:
This diploma thesis deals with the legal frameworks of human rights. Human rights are undoubtedly one of the biggest and most important achievements of the society in the modern era. For the first time in the history of mankind, the people were guaranteed a decent life in freedom, justice and peace. Legal system and protection of human rights became the responsibility each individual country and international community. That’s how human rights became universal, and today it is recognized everywhere and for everyone. The diploma thesis view the beginning of the development of human rights through key historical events and legal documents, which have contributed to the emergence of human rights as we know them today. Taking into account the different conceptions of human rights the diploma thesis describes the concept of human rights as stemming from the International Bill of Human Rights. Special attention is given to the main chapter, namely the legal framework of human rights. The starting point of the diploma thesis is the description of the International Human Rights Law which is complemented with the international-regional and national law. It examines the International Bill of Human Rights and the remaining seven key international documents covering different fields of human rights namely: civil and political rights, economic, social and cultural rights, racial discrimination, discrimination against women, torture, children, migrant workers and members of their families, forced disappearance and persons with disabilities. The diploma thesis concludes with a description of the supervisory mechanisms that watch over the implementation of human rights and the description of institutes which are available for the individual that can be used in a case when there is a violation of the individual human rights.
