Title:PRAVNO VARSTVO V OKVIRU PROSTEGA PRETOKA VARNIH IN KAKOVOSTNIH ŽIVIL SKOZI UREDBO(EU) ŠT. 1169/2011

Abstract:Osrednjo problematiko diplomskega dela predstavlja pravno varstvo potrošnika na notranjem trgu Evropske unije. Zaradi prostega pretoka živil je le-ta v skladu s prakso poštenega informiranja (7. člen Uredbe (EU) št. 1169/2011) upravičen do varnih in kakovostnih živil. Na analizo dotične problematike sem se osredotočila z vidika Uredbe (EU) št.1169/2011 o zagotavljanju informacij o živilih potrošniku, ki zaradi novosti, ki jih uvaja, poostruje položaj treh interesnih strani: zakonodajalca, potrošnika in nosilca živilske dejavnosti. V prvem delu je skozi koncept varne hrane predstavljen razvoj evropske živilske zakonodaje od 90-ih let prejšnjega stoletja do danes, ki predstavlja podlago za analizo položaja Republike Slovenije po vstopu v EU, njene usmeritve na tem področju in pravne podlage. Drugi del diplomskega dela je namenjen izključno predstavitvi Uredbe (EU) št. 1169/2011, natančni razlagi in interpretaciji novosti, ki jih uvaja za potrošnika, ter razlagi, kaj smo pravzaprav pridobili z uveljavitvijo nove uredbe, ki združuje in nadgrajuje vse prejšnje. Zadnji del diplomskega dela, ki se osredotoča na pravno varstvo evropskega potrošnika, zaokroža delo v smiselno celoto. 169. člen Pogodbe o delovanju Evropske unije dodeljuje potrošniški politiki samostojen značaj, katere ključna vodila naj bodo pravica do varnosti, pravica do obveščenosti in pravica do izbire. Analizirala sem pravne podlage in organe obveščanja, na katere se lahko v primeru zlorab predpisov obrne slovenski potrošnik, hkrati pa pomembno poglavje tretjega dela predstavlja pomen zdravstvenih in prehranskih trditev, ki nemalokrat vplivajo na potrošnika ob nakupu. Diplomsko delo je dopolnjeno z raziskavami Ministrstva za zdravje, Inštituta za sanitarno inženirstvo in Evropske komisije, ki povzemajo potrošnikovo ozaveščenost in njegovo mnenje o gensko spremenjenih organizmih v časovnem obdobju med leti 2007-2010.

Title:LEGAL PROTECTION OF FOOD SAFETY AND QUALITY UNDER THE FREE MOVEMENT OF GOODS FROM THE PERSPECTIVE OF REGULATION (EU) No 1169/2011
Abstract:Central issue of the thesis evinces the legal protection of consumers in the internal market of the European Union. Due to the free movement of foodstuffs it is in accordance with fair information practice (Article 7 of the Regulation (EU) No. 1169/2011) to be entitled to safe and wholesome foodstuffs. Particular problems have been analyzed from the perspective of the Regulation (EU) No 1169/2011 on the provision of food information to consumer, which, due to innovations introduced by itself, reinforces the situation of three stakeholders: the legislator, the consumer and the food business operator. First part through the concept of safe food introduces the development of European food law from the 90s until today, which forms the foundation for the analsys of the situation of the Republic Slovenia after joining the EU, its policies in this field and legal ground. Second part of the thesis is dedicated exclusively to the presentation of Regulation (EU) No. 1169/2011, the elaboration and interpretation of the innovations, introduced for the consumer and the explanation, what exactly have we gained with the implementation of the new regulation, which integrates and upgrades all the previous ones. Last part of the thesis, which focuses on the legal protection of European consumers,wraps the discussion into a integral whole. Article 169 of the Treaty on the Functioning of the European Union allocates the consumer policy autonomous character, which exposes as key following principles: right to safety, right to information and freedom of choice. I analyzed legal standing and authority media, which have to be approached by slovenian consumers in the case of abuse of the provisions. Additionally, significant section of the third part is the importance of health claims and nutrient content claims, which often affect the consumer at the time of purchase. Thesis is supplemented by researches of the Ministry of Health, the Institute for Sanitary Engineering and the European Comission, summarizing consumer's awareness and his opionion on GMOs (Genetic Modified Organisms) in the period between 2007-2010.
