Title:Ekskluzija dokazov : primerjalni vidik

Abstract:Dokazni postopek ni le orodje v rokah sodišča za popolno in pravilno ugotovitev dejanskega stanja, ampak je predvsem sredstvo, s pomočjo katerega stranki uveljavljata svoje zahtevke in verzije, na katerih temeljijo ti zahtevki. V dokaznem postopku se torej ugotavlja resnica o dejanskem stanju dogodka. Nezakoniti dokazi so dokazi, ki so bili pridobljeni nezakonito in to pomeni, da so bile kršene človekove pravice, ali pa so bili pridobljeni na procesno nedopusten način. Z izločitvijo dokazov se prepreči, da bi tožilstvo na sodišču uporabilo dokaze, ki so bili pridobljeni na nezakonit način. Dokazi pridobljeni nezakonito morajo biti izločeni iz dokaznega gradiva in se na sojenju ne smejo uporabiti. Pojem ekskluzije izvira iz Združenih držav Amerike in je tam tudi najdosledneje izpeljan. Je širši pojem, ki pokriva tudi pojem sadeža zastrupljenega drevesa. Institut izločitve dokazov je eno izmed osnovnih in najbolj pomembnih varoval v kazenskem procesnem pravu, saj je temeljna naloga države, da zagotovi pošten in pravičen kazenski postopek. Vsaka izmed držav pa ima svojo zakonodajo, ki določa pravni okvir ekskluzije dokazov. Vsekakor pa ne smejo biti ne glede na posamično zakonodajo držav glede ekskluzije kršene človekove pravice in svoboščine. Namen ekskluzije je, da preventivno vpliva na nezakonitost dela policije z opozorilom, da dokazi, ki bodo zbrani s kršitvijo ustavno določenih človekovih pravic in temeljnih svoboščin ter s kršitvijo kazenskega postopka, ne bodo imeli procesno pravne veljave, ker na njih ne bo mogoče opreti sodne odločbe. Za vsako dokazno prepoved je podana tudi sankcija. Ugotovili smo, da doktrina sadeža zastrupljenega drevesa predstavlja širši pojem ekskluzije dokazov, da ekskluzija vzpostavlja enakost razmerja med državo in posameznikom ter da ekskluzija predstavlja problem za tožilce. Zaradi različnih pravnih ureditev pa ima vsaka država ekskluzijo urejeno drugače.

Title:EXCLUSION OF EVIDENCE – A COMPARATIVE PERSPECTIVE
Abstract:The taking of evidence is not only a tool in the hands of the court for a full and accurate statement of the facts, but a means by which the parties assert their claims and versions on which these requests are based. The proof procedure therefore finds the truth about the real state of the event. Illegal evidence is evidence that they were obtained illegally and this means that the human rights violations that have been obtained in the process in an intolerable manner. Exclusion of evidence prevents the prosecution, at the court to use evidence that has been acquired in an unlawful manner. Evidence obtained illegally must be excluded from evidence, and the trial must be repealed. Concept of exclusion originates from the United States, and there is also consistently carried out. It is general concept, which also covers notion fruits of poisoned tree. Exclusion of evidence is one of the basic and most important safeguards in the criminal procedural law, since it is the fundamental task of the state to ensure fair and equitable criminal proceedings. Each country has its own legislation providing a legal framework exclusion of evidence. However, it should not be regardless of the individual countries regarding legislation exclusion, violated human rights and freedoms. The purpose of exclusion is preventive effect on the illegality of the police warning, that the evidence will be collected in violation of the constitutional human rights and fundamental freedoms and the breach of the criminal proceedings will not have a procedural legal force, because it will not be possible to rely case decision on them. We found out that doctrine fruit of poisoned tree represents a broader concept of exclusion of evidence, that exclusion establishes equality between the state and individuals, and that exclusion is a problem for prosecutors. Due to different legal arrangements, each country has different regulation of exclusion.
