Title:Notranji trg in prodaja prehranskih dopolnil v Evropski unij : diplomsko delo

Abstract:Evropska unija je v zadnjih desetletjih začela aktivno urejati zakonodajo na področju živil, vključujoč prehranska dopolnila. Razloga za sprejetje sta bila predvsem dva, in sicer uresničevanje prostega pretoka blaga na območju Evropske unije in omejevanje pretoka prehranskih dopolnil, ki bi bila lahko nevarna za potrošnike. V letu 2002 je Evropska unija sprejela prvi zakonodajni akt, ki je urejal področje prehranskih dopolnil, Direktivo o prehranskih dopolnilih, ki vsebujejo vitamine in minerale. Kljub delni urejenosti tega področja je precejšen del še vedno neurejen, saj obstajajo še druge sestavine, ki jih vsebujejo prehranska dopolnila (in zavzemajo 50 odstotkov trga prehranskih dopolnil v Evropski uniji), poleg tega Evropska agencija za varnost hrane še vedno ni uredila mejnih vrednosti vitaminov in mineralov, ki so lahko prisotni v prehranskih dopolnilih. Skladno z zgoraj omenjeno neurejenostjo prihaja do kršitev prostega pretoka prehranskih dopolnil s strani držav članic in kršitev načela vzajemnega priznavanja. Zakonodaja Evropske unije na področju prehranskih dopolnil je na ozemlju Evropske unije gotovo ena izmed najbolj kritiziranih s strani strokovne javnosti in poslovnih subjektov, ki se ukvarjajo s prodajo prehranskih dopolnil. Kljub temu se številne regije in države zgledujejo po njej. V kolikor želi Evropska unija doseči svoj primarni cilj, prosti pretok blaga, bo potrebno v celoti uskladiti zakonodajno urejanje prehranskih dopolnil, skladno s pričakovanji strokovne javnosti in varovanjem zdravja potrošnikom.

Abstract:In past decades the European Union has started to actively regulate the foodstuffs legislation, including food supplements. Reasoning behind the need to regulate this area was the need to establish free movement of food supplements in the European Union and to eliminate food supplements from the European Union market that could endanger the consumer. In 2002 the European Union adopted the first legislative act regulating food supplements, Directive on food supplements containing vitamins and minerals. Despite partial legislative framework, a significant part of this area of food supplements is still unregulated, namely food supplements including other substances than vitamins and minerals (which occupy half share of European Union market of food supplements) and in addition the European Food Safety Authority has not yet regulated tolerable upper levels of vitamins and minerals for food supplements. As a consequence of this unregulated areas, freedom of movement and principle of mutual recognition are breached by the member states of European Union. European Union legislation on food supplements, despite being one of the most criticized from the professional public and economic operators within the European Union, is an example to many other regions and countries when drafting similar legislative acts. To achieve the primary object of the European Union, freedom of movement of goods (food supplements), legislation of this area will have to be harmonized as whole, in accordance with expectations of professional public and economic operators, while protecting the health of consumers.
