Abstract:V diplomskem delu je predstavljeno področje sovražnega govora kot eno najnevarnejših oblik komuniciranja, ki se vse intenzivnejše pojavlja v spletnih medijih, proti marginaliziranim in ranljivim skupinam pa se izraža skozi diskriminatorni diskurz. To osvetljuje problem anonimnosti in prikritih identitet, s katerimi imajo uporabniki še več možnosti za razpihovanje sovraštva in širjenje nestrpnosti, tovrstno izražanje mnenj pa se tolerira pod krinko demokracije in svobodnega govora. Pravica do svobode izražanja je namreč določena s slovensko ustavo, ki hkrati prepoveduje spodbujanje k neenakopravnosti in sovražnosti, zato je med njima težko poiskati pravo ravnovesje. Diplomsko delo opisuje problem prepoznavanja kaznivega sovražnega govora, ki se ga pogosto zamenjuje s političnim, sodbenim, žaljivim in nestrpnim govorom kot oblikami neprimernega govora v komentarjih spletnih medijev, ki močno posegajo v človekovo pravico do osebnega dostojanstva in ogrožajo kulturo dialoga. Izpostavlja tudi pomanjkanje sodne prakse, ustrezne zakonodaje in kazenskih določil pri omejevanju sovražnega govora v forumskih vsebinah in določevanju, pod kakšnimi kriteriji bi moral biti sankcioniran.

Title:COMMENT FIELDS IN WEB-MEDIA AS A HATE SPEECH PLATFORM
Abstract:Presented in this diploma is the area of hate speech as one of the most dangerous forms of communication, which is more and more intensively appearing in web media and is against marginalized and vulnerable groups expressed through discriminatory discourse. This highlights the problem of anonymity and covert identities, with which users have even more possibilities for hate inflaming and intolerance spread, this kind of expression is yet tolerated under the mask of democracy and free speech. The right to freedom of expression is namely determinated with Slovenian constitution, which also prohibits incitement to discrimination and hostility, therefore the right balance between them is difficult to find. This diploma describes the problem of identifying criminal hate speech, which is often confused with political, judging, offensive and intolerant speech as forms of inappropriate speech in comment fields of web media that strongly affect the human right to personal dignity and undermine the culture of dialogue. It also stress the lack of case law, adequate legislation and penal provisions for limiting hate speech in forum content and determinating, under what criteria it should be sanctioned.
