Abstract:Glavni namen in naloga delovnopravne zakonodaje je zagotavljanje varstva delavcem in zaščita pred kršitvami njihovih pravic. Delavcu so na voljo različni instituti, ki se jih lahko posluži za varstvo svojih pravic. V primeru prenehanja pogodbenega razmerja na podlagi delodajalčeve odpovedi, lahko delavec vloži tožbo pred pristojnim sodiščem, da ugotovi zakonitost delodajalčevega ravnanja. Če sodišče po izvedenem dokaznem postopku, ugotovi, da je pogodba o zaposlitvi prenehala nezakonito oziroma je delovno razmerje prenehalo na drug način, ki ni zakonit, v večini primerov delavca vrne na delo k delodajalcu (t.i.reintegracija), saj zaposlitev predstavlja glavni ali celo edini vir njegovega dohodka. 118. člen Zakona o delovnih razmerjih (ZDR-1) pa dopušča tudi drugo možnost, da ob izpolnjenih predpostavkah, sodišče namesto ponovne vzpostavitve delovnega razmerja, razveže pogodbo o zaposlitvi, ugotovi trajanje delovnega razmerja do določenega dne, delavcu prizna vse pravice iz delovnega razmerja ter mu dosodi denarno povračilo, kot vrsto nadomestila za reintegracijo. Reintegracija ima prednost pred odškodnino že v najpomembnejših mednarodnih dokumentih s področja prenehanja pogodbe o zaposlitvi, ki spodbujajo države podpisnice, da uskladijo nacionalno zakonodajo s njihovimi usmeritvami.

Title:REINTEGRATION
Abstract:Principal purpose and function of labor law legislation is to ensure security for employees and to protect them from possible violation of their rights. There are several institutes in which worker can seek justice and protection of rights. In case if an employer decides to terminate contactual relationship, an employee can file action to the authority, to see if the employer played by the books. If after probative process, the court finds any evidence about ilegal ending of working contract, in most cases the court than returns the employee back to work for the employer (reintegration), because that job probably is the only source of incomes for that certain worker. Article 118. of Law on employment permits an alternative solition, of course only when fulfilled assumptions are considered. And if they are, the court can dissolve the emloyment contract, determines duration of the contract and recognizes all the rights towards the employee and also grants the worker an indemnification, which is considered as a way of compesation for reintegration. Reintegration is prior to indemnification in all significant international documents from the field of termination of empoyement treaties, which encourages state parties to align national legislation with their directions and guidelines.
