Title:Načini upravljanja korupcije v sodobni družbi : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Cilj diplomske naloge je analizirati usklajenost sistemskih dejavnikov (institucij, zakonodaje itd.) v Republiki Sloveniji s sosednjimi državami ter z mednarodnimi institucijami. Osredotočimo se predvsem na načine upravljanja korupcije v naši državi in njene elemente za upravljanje ter institucije, ki te elemente implementirajo v družbeni sistem. Korupcija je kaznivo dejanje za pridobitev premoženjske koristi. Obstaja v družbi, a jo ta zanika, saj skoraj nobeden v družbi ni nedolžen. Korupcija zajema več pojmov, kot so pravo podkupovanje, nepravo podkupovanje itd. Poleg tega se korupcija deli še na različne vrste in oblike. Ta dejanja so podkupovanje, izsiljevanje, goljufija itd. Da bi ta dejanja lahko nadzorovali, so nam v pomoč različne državne in nedržavne organizacije, ki se s tem ukvarjajo, recimo OZN, Interpol, Evropska unija, Svet Evrope, Greco, Transparency International. Za Slovenijo in ostale države članice Evropske unije je pomembno mednarodno sodelovanje z organizacijami. Za uspešno doseganje ciljev pa je pomembno tudi oblikovanje strategij za upravljanje korupcije, tako na področju sistemske korupcije kot na področju organiziranega kriminala. Na prvem področju gre za pospešitev sodelovanja držav članic z mednarodnimi organizacijami, na drugem pa je pomembna implementacija inštituta obratnega dokaznega bremena. Omenjene strategije pa morajo v sistem implementirati organi nadzora korupcije, kot so policija, sodstvo, tožilstvo. To se razlikuje po posameznih državah. Osredotočimo se predvsem na naše sosednje države; na Hrvaško, Italijo, Madžarsko in Avstrijo. Vse te države imajo podoben sistem upravljanja s korupcijo, vendar imajo, predvsem zaradi položaja države na politični in gospodarski ravni, različno stopnjo korupcije. V Sloveniji in njenih sosednjih državah so kazalniki korupcije skoraj enaki; to so velika denarna plačila, sprejemanje daril itd. Konec koncev velikih razlik ni, dejstvo pa je, da se korupcija širi.

Title:HOW TO MANAGE CORRUPTION IN A CONTEMPORARY SOCIETY
Abstract:The aim of the thesis is to analyze the consistency of systemic factors (institutions, legislation ...) in the Republic of Slovenia with neighboring countries and with international institutions. I focused mainly on ways of managing corruption in our country and its elements to manage and institutions that implement these elements in the social system. Corruption is a crime of obtaining material benefits. It exists in society, but the society only denies this, because almost none in the society is innocent. The concept of corruption is divided into several concepts such as bribery law, quasi- bribery ... In addition, corruption is divided in various types and forms. These acts are bribery, extortion, fraud, ...That those actions can be monitored, various state and non-state organizations that deal with it, such as the UN, Interpol, the European Union, Council of Europe, Greco, Transparency International, help us out. For Slovenia and other Member States, it is important that we cooperate with these international organizations. In order to successfully achieve the objectives it is also important to design strategies for the management of corruption, both in terms of systemic corruption and organized crime. The first field is a step up cooperation of Member States with international organizations, on the other side, it is important to implement the Institute of reverse burden of proof. These strategies should be implemented into the system by the corruption control bodies such as the police, the judiciary, and the prosecutor's office. This, of course, varies by different countries. I focused mainly on our neighboring countries, Croatia, Italy, Hungary and Austria. All of these countries have a similar system of governance to corruption, but in them, mainly due to the position of countries in political and economic level, they all have a different proportion of corruption. In Slovenia and its neighboring countries the indicators of corruption are almost the same like large cash payments, acceptance of gifts ... Ultimately, there are no significant differences, but the fact is that corruption is spreading.
