Abstract:
Zdravstvena dejavnost je lahko organizirana kot javna služba, ki jo opravljajo javni zdravstveni zavodi v okviru Ministrstva za zdravje. Zaradi narave dejavnosti se javna služba v zdravstvu opravlja na primarni, sekundarni in terciarni ravni ter je povezana z zagotavljanjem 24-urnega neprekinjenega zdravstvenega varstva in neprekinjene nujne medicinske pomoči. Vprašanje delovnega časa je predmet nacionalnega in mednarodnega urejanja, predvsem z vidika varovanja delavčevega zdravja in sposobnosti v njegovem celotnem aktivnem življenjskem obdobju. V nalogi sem predstavila ureditev delovnega časa v okviru aktov Organizacije združenih narodov, Mednarodne organizacije dela, Sveta Evrope in Evropske unije ter ureditve v Republiki Sloveniji. Na državni ravni določajo pravice in obveznosti delavcev, zaposlenih na področju zdravstvene dejavnosti, Zakon o delovnih razmerjih, Zakon o javnih uslužbencih, Zakon o zdravstveni dejavnosti in Zakon o zdravniški službi. Za razmerje med Zakonom o delovnih razmerjih in Zakonom o javnih uslužbencih ter področnima zakonoma (Zakon o zdravstveni dejavnosti in Zakon o zdravniški službi) velja načelo lex specialis derogat legi generali, kar pri ureditvi delovnega časa na področju zdravstva pomeni, da se uporabljata področna zakona kot lex specialis. Poleg tega pa se v zdravstvu ureja delovni čas tudi s kolektivnimi pogodbami, in sicer s Kolektivno pogodbo za dejavnost zdravstva in socialnega varstva Slovenije, Kolektivno pogodbo za zdravnike in zobozdravnike ter Kolektivno pogodbo za zaposlene v zdravstveni negi. Ugotovila sem, da so akti, ki opredeljujejo delovni čas v zdravstvu, usklajeni z mednarodnimi univerzalnimi in regionalnimi akti ter, da bi z drugačno organizacijo delovnega časa v zdravstvu lahko zmanjšali število nadur in ur dežurstev. V nalogi predstavljam oblike delovnega časa, ki so ali bi lahko bile značilne za zdravstvo. To so polni delovni čas, izmensko delo, krajši delovni čas, dopolnilno delo, neenakomerno razporejeni in začasno prerazporejeni delovni čas, dežurstvo ter nadurno delo.

Title:
Time in the field of health care in Slovenia
Abstract:
Health activity may be organized as a public service performed by public health institutions under the Ministry of Health. Due to the nature of the service the public service in health care is provided at primary, secondary and tertiary level and is associated with providing 24 - hour continuous care and continuous emergency medical services. The issue of working time is a subject of national and international regulation especially with regard to the protection of workers and workers' health and skills throughout their active life period. In this paper I present working arrangements under the acts of the United Nations, ILO, Council of Europe and the European Union, and regulation in the Republic of Slovenia. At the national level are the rights and obligations of workers employed in health care regulated by Employment Relationship Act, Civil Servants Act, Health Services Act and General Practitioner Services Act. The relationship between the Employment Relationship Act and the Civil Servants Act and sector-specific acts Health Services Act and the General Practitioner Services Act underlies the principle lex specialis derogat legi generali, this in case of working time arrangements in the health care sector means that the sector-specific acts are used as lex specialis. In addition, the working time in health care sector is regulated with collective agreements namely: the Collective Agreement for the Health care and Social care activity in Slovenia, the Collective agreement for physicians and dentists and the Collective contract for persons employed in health care services. In this paper I present forms of working time, which are or may be specific to health care. These are full-time work, shift work, part-time work, supplementary work, unevenly distributed working time and temporarily reordered working time, orderly duty and overtime work.
