Abstract:Diplomska naloga govori o ogledu kraja kaznivega dejanja s strani preiskovalnega sodnika in tožilca v naši državi, kjer se pojavi vprašanje definicije tega dejanja. Ogled je eno od osrednjih preiskovalnih dejanj, saj je na kraju dejanja skrit ključ za razjasnitev kaznivega dejanja. Zlasti pa zavzema ogled pomembno mesto med preiskovalnimi dejanji zato, ker se na ta način lahko organ kazenskega postopka sam neposredno prepriča o obstoju ali neobstoju kakšnega dejstva. Ogled kraja dejanja je tako neločljiva celota iskanja, zbiranja in ugotavljanja dejstev, ki so pomembna za spoznavanje resnice v kazenskem postopku, ter fiksiranja in procesnega zavarovanja dokazov, ki jih sodišče potrdi in uporabi za dokazovanje krivde šele na glavni obravnavi. Torej sta pri ogledu enako pomembni tako aktivno-miselno-zaznavna dejavnost kot dokazna dejavnost. Ogled je po značaju lahko operativno-taktično dejanje ali formalno preiskovalno dejanje, po času je lahko v predkazenskem postopku ali v preiskavi ter med glavno obravnavo in izven nje, po izvajalcu pa ga lahko opravlja policist, kriminalist ali preiskovalni sodnik. Najpogosteje se ogled opravlja kot nujno preiskovalno dejanje še pred formalnim sklepom o preiskavi. Takoj, ko je odkrito dejanje, ki vsebuje znamenja kaznivega dejanja, je treba kraj pregledati, da se potrdi sum o kaznivem dejanju, da se zberejo dokazi in izsledi storilec. Dotaknila se bom prenove kazenskega postopka, katerega osnutek je ministrstvo za pravosodje že leta 2008 objavilo na svoji spletni strani. Nujnost prenove kazenskega postopka zajema tudi spremenjena zasnova postopka, v katerem bi imeli policija, državni tožilec in sodišče bistveno spremenjeno vlogo. V preiskovalnem postopku bi tako preiskovalno funkcijo opravljal državni tožilec in policija, vlogo garanta obdolženčevih pravic pa bi opravljal predobravnavni sodnik. Navedeni so tudi razlogi za odpravo preiskave in instituta preiskovalnega sodnika.

Title:VIEW SCENE OF CRIME BY THE INVESTIGATING JUDGES AND PROSECUTORS
Abstract:The topic of this degree thesis is the investigation of a crime scene performed by the examining magistrate and prosecutor in our country, where a definition of this act needs to be added. Investigation is one of the key investigating acts, since there is a key to solving the criminal offence hidden at the crime scene. Especially, the crime scene investigation has an important part during the examination acts, because this way the criminal offence authority can be directly convinced of the existence or nonexistence of a certain fact. Investigation of a crime scene is thereby an inseparable totality of searching, collecting and assessment of facts which are important for learning the truth in the criminal procedure. Additionally, for fixation and process insurance of evidence, validated and used by the court of law to prove one’s guilt no sooner than at the main hearing. Therefore, the actively-mental-perceivable activity, as well as the evidence (collecting) activity are equally important. An investigation can be an executive-tactical act or formal-investigating act. According to time, it can be performed in a pre-trial criminal procedure or in investigation, and during the main hearing or outside it. According to the performer, it can be carried out by a police officer, criminal investigator or examining magistrate. The most often, an investigation is performed as an urgent investigative act even before the formal decision about investigation is made. As soon as a deed with signs of a criminal act is discovered, something needs to be investigated to confirm suspicion of a criminal act, to collect all evidence and to trace the offender. I am going to address the reform of the criminal procedure, the law draft of which was published on the website by the Ministry of Justice in 2008. The necessity of the reform of the criminal procedure includes changed design of the procedure, too. The role of police, state prosecutor and the court of law would fundamentally change. Moreover, the investigative function in the investigation procedure would be performed by the state prosecutor and police, whereas the role of a guarantor of rights of the person charged would be carried out by the pre-trial judge. Furthermore, the reasons for the withdrawal of the investigation and the institute of examining magistrate are stated, as well.
