Abstract:
Po uvodu je v prvem delu diplomskega dela predstavljena zakonodaja, ki velja in ureja področje varnosti smučanja. Poglavitni zakon je Zakon o varnosti na smučiščih, ki ureja navedeno tematiko, poudarja in razširja pristojnosti ter naloge nadzornikov na smučišču in poudarja načelo samoodgovornosti smučarja. Poleg navedenega zakona so za varnost poglavitna tudi FIS pravila, ki jih je dolžan spoštovati vsak upravljavec smučišča ter predvsem smučarji sami, saj vsebujejo minimalne standarde o varnosti na smučiščih. V drugem delu je opredeljena in predstavljana odgovornost na splošno, predpostavke, ki morajo biti izpolnjene za nastanek odgovornosti ter vrste odgovornosti, saj je razumevanje tega področja ključno za ugotavljanje odškodninske odgovornosti v primeru nastanka nezgode na smučišču. Osrednji del diplomskega dela pa predstavlja razjasnitev odgovornosti posameznika kot smučarja ter upravljavca smučišča. Teorija je za lažje razumevanje podprta s sodno prakso, v kateri so predstavljeni najpogostejši primeri nezgod, ki se lahko pripetijo na smučišču. Polega navedenega so v osrednjem delu predstavljene problematike, ki zadevajo to področje. Kljub temu, da sicer imamo zakone, ki urejajo to področje pa se pojavlja problem nezadostnega definiranja urejenosti prog, ki bi jih moral zagotoviti upravljavec smučišča za varno smuko, kritično področje je tudi vprašanje hitrosti, ki naj bi bila na smučiščih dovoljena, saj je hitrost odvisna od mnogih dejavnikov in je njena ocena lahko zelo subjektivna in da se lahko upravljavec smučišča za razbremenitev svoje odgovornosti skoraj vedno sklicuje na to.

QUESTIONS REGARDING LIABILITY IN CASE OF THE SKI ACCIDENT
Abstract:
After the introduction, the first part of the thesis presents the laws governing and regulating the safety of skiing. The main law is the Law on safety on the slopes, which governs the subject, highlights and extends the powers and duties of the ski resort, and emphasizes the principle of ownership skier. In addition, the law for the safety of the main FIS rules, which is required to comply with any ski area operator and above skiers themselves, since they contain minimum standards of safety on the slopes. The second part is defined and is represented on the general responsibility of the assumptions that must be met for liability and liability classes, because the understanding of the key areas for establishing liability in case of accidents on the slopes. The central part of the thesis presents clarifying individual responsibilities as a skier and the ski resort. The theory is supported to facilitate the understanding of the case law, in which the most frequent examples of accidents that can happen on the slopes. In addition, in the central part of the problem presented to address this area. Despite the fact that, while we have laws governing this area, there is the problem of insufficient definition of order lines, which should be to ensure operator safety ski touring, critical area is the issue of speed, which should be allowed on the slopes, as the speed depends on many factors and its score can be very subjective and that the ski area operator to relieve their responsibilities almost always rely on it.
