Title:PRIMERJAVA STEČAJA PRAVNE OSEBE IN OSEBNEGA STEČAJA PODJETNIKA

Abstract:Vsaka pravna oseba in tudi podjetnik prične svojo dejavnost z namenom uspešnega poslovanja. Navkljub dobrim namenom stvari ne izpadejo vedno tako, kot si jih zastavimo. Tako se znajdemo v situaciji, ko naših dolgov več ne moremo poplačati. V takšnih primerih je možna rešitev predlog za stečaj. Ta je lahko bodisi osebni bodisi stečaj pravne osebe. V diplomskem delu smo tako predstavili oblike stečaja, njihove posledice ter prisotne organe. V tretjem poglavju pa smo predstavili še dva primera iz prakse – osebni stečaj podjetnika ter stečaj pravne osebe. V nadaljevanju diplomskega dela smo si zastavili še 4 trditve. Te smo preko podatkov, dobljenih na spletnih straneh AJPES-a, ter določil v ZGD in ZFPPIPP tudi preverili. Dve izmed njih smo na koncu potrdili, medtem ko smo drugi dve ovrgli.

Title:COMPARISON OF COMPANY BANKRUPTCY AND BANKRUPTCY OF AN ENTREPRENEUR
Abstract:Every legal person as well as a businessman, starts his activity with intention of successful business. In spite of good intentions, things do not always end up as we would like. We find ourselves in situations where our dept can not be repaid any more. In such cases, a possible solution is a proposal for bankruptcy. This can be either a personal bankruptcy or bankruptcy of a legal person. I presented these two forms of bankruptcy and their consequences in my dissertation. I also introduced two examples from practice – a personal bankruptcy of an entrepreneur and a bankruptcy of a legal person. In continuation of my dissertation, I tested 4 hypotheses. The data needed for testing was obtained from AJPES’s website, Financial Operations, Insolvency Proceedings and Compulsory Dissolution Act (ZFPPIPP) and Companies Act (ZGD). We confirmed two of the hypotheses, while the other two were disproved.
