Title:Pregled osebe kot varnostno in procesno pooblastilo policije : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Namen diplomskega dela je pravna analiza ureditve pregleda oseb, kot varnostnega in procesnega pooblastila policije. V tej povezavi je prav tako obravnavana tematika pregleda prevoznih sredstev, potnikov in prtljage. Diplomsko delo obravnava tudi primerljivo pravno ureditev v drugih državah. Vsa omenjena pooblastila pomenijo določen poseg v človekove pravice in temeljne svoboščine, predvsem v poseg v pravico do zasebnosti in telesne celovitosti. Uvod je namenjen predstavitvi pomena policijskih pooblastil v družbi, ter zakaj je pomembno, da policisti svoja pooblastila natančno poznajo. Samo jedro diplomskega dela je namenjeno predstavitvi posameznih pooblastil pregleda osebe, varnostnega pregleda, pregleda prevoznega sredstva potnikov in prtljage ter osebne preiskave in njihovi razčlenitvi. S prikazom na določenih primerih sem skušal upravičiti poseg takšnih pooblastil v človekove pravice in temeljne svoboščine. Nekaj poudarka je podanega tudi doktrini Stop and frisk, katero je razvilo Vrhovno sodišče ZDA. V sklepu je predstavljena primerjava posameznih obravnavanih pooblastil ter primerljiva pravna ureditev v Avstriji in Združenih državah Amerike.

Title:INSPECTION OF PERSON AS A SECURITY AND PROCEDURAL POLICE POWER
Abstract:The purpose of thesis is a legal analysis of the oversight arrangements of people, such as security and police procedural powers. In this connection it is also a subject matter review of means of transport for passengers and luggage. The diploma thesis deals with a comparable regulation in other jurisdictions. All these powers for a certain interference with human rights and fundamental freedoms, especially in infringement of the right to privacy and bodily integrity. The introduction is intended to present the importance of police powers in society, and why it is important that officers know exactly their powers. The core thesis is devoted to the presentation of each person the powers of inspection, safety inspection, examination of means of transport of passengers and baggage and personal investigations and their breakdown. The demonstration in certain cases, I tried to justify the intervention of such powers in the human rights and fundamental freedoms. Some emphasis is also given doctrine and Fresh Stop, which has been developed by the U.S. Supreme Court. In conclusion, a comparison of the individual powers and comparable regulation in Austria and the United States.
