Abstract:
Javne službe lahko razdelimo na gospodarske in negospodarske. Med negospodarske spada tudi zdravstvena dejavnost, ki se deli na primarno, sekundarno in terciarno raven. Lahko jo opravljajo domače in tuje fizične in pravne osebe. Zdravstvena dejavnost kot javna služba se lahko opravlja v obliki javnega zdravstvenega zavoda, v obliki pravne osebe ali kot zasebni izvajalec. V drugem in tretjem primeru je za opravljanje zdravstvene dejavnosti potrebno pridobiti koncesijo, ki pomeni dovoljenje za vstop v mrežo javne zdravstvene službe. Lahko pa se zdravstvena dejavnost opravlja tudi v obliki čistega zasebništva. Koncesije na področju zdravstva se podeljujejo na voljo strank, brez javnega razpisa, kar je največja pomanjkljivost tega postopka. Koncesije za opravljanje zdravstvene dejavnosti kot javne službe podeljujejo pristojni občinski oziroma mestni upravni organi ter ministrstvo za zdravje. Zakon o zdravstveni dejavnosti določa postopek podelitve koncesije in obvezno dokumentacijo, ki je podlaga za odločitev upravnega organa oziroma za izdajo odločbe. Pogodbeno razmerje pri koncesijah v zdravstvu je razdeljeno na dva dela: na koncesijsko pogodbo, ki podeli le pravico opravljati javno službo, in pogodbo med koncesionarjem in Zavodom za zdravstveno zavarovanje Slovenije, ki uredi obseg izvajanja zdravstvenih storitev in plačilo zanje. Javni zdravstveni zavodi in koncesionarji opravljajo javno službo pod enakimi pogoji. To pa ne pomeni, da so ti pogoji tudi v resnici enakopravni. Da lahko zdravnik opravlja zdravstveno dejavnost na podlagi koncesije, mora izpolnjevati določene pogoje.

CONCESSION IN HEALTH CARE
Abstract:
Public services can be divided into economic and non-economic services. Among latter one also health services are included; they divide into primary, secondary and tertiary care level. Health services can be offered by native and foreign natural and legal person. Health service as a public service may be provided in a form of public health institution by legal entity or by private practitioner. When the second and the third possibility is a case, a concession has to be obtained; with which a concessionaire is permitted to enter the public health service network. Alternatively, health services can be provided by a physician, working independently. Concessions on health are awarded at the request of parties without any open call for competition - what is the biggest faultiness of the procedure. Concessions for the provision of health service as a public service are awarded by competent municipal or local administrative authorities and the Ministry of Health. Health Service Act establishes concession-awarding procedure and compulsory documentation on the basis of which the administrative authority may decide; that is deliver a decision. In the field of concessions in health, the contractual relationship is divided into two parts: the concession contract, which grants only the right to perform public service, and “An Agreement,” a contract between a concessionaire and the Health Insurance Institute of Slovenia, which arranges the range of health services and pay for them. Public health institutions and concessionaires are engaged in public service under the same conditions. However, this does not mean that the conditions are equal in fact; a physician, being permitted to perform health service with a concession has to meet certain conditions.
