Abstract:
Delovno pravo za pomorščake je, kot večina pomorskega prava, močno unificirano. Delovna razmerja v pomorstvu so urejena drugače od splošne delovne zakonodaje zato, ker je narava dela drugačna. Pomorščaki so ves čas na ladjah, tudi ko imajo čas za počitek, izpostavljeni so različnim vremenskim vplivom, ob tem pa morajo ves čas skrbeti za varnost plovbe, tovora in posadke. Ker so pogoji dela za vse pomorščake v grobem enaki, so se skozi konvencije Mednarodne organizacije dela (MOD), konvencije Mednarodne pomorske organizacije (IMO), delo ITF-ja in, na evropskem nivoju, evropskega socialnega dialoga, tudi pogoji zaposlitve, načina dela, socialnega varstva, dokumentov, odpovedi pogodb, plačil in dopusta močno izenačili. Najnovejša konvencija MOD, Konvencija o delovnih standardih v pomorstvu, bo, ko bo stopila v veljavo, še dodatno poenotila standarde zaposlovanja in dela. Slovenija sledi razmeram v mednarodni skupnosti.

Title:
EMPLOYMENT OF THE SEAFARERS
Abstract:
Labour law for seafarers is mainly unified throughout the World, as all the fields of maritime law are. Since the nature of the work is different, employment relationships in maritime affairs are regulated in a different manner than general labour legislation. Seafarers are aboard the ships at all times -- even when it is time to rest. They are exposed to various weather influences and constantly have to pay attention to the safety of the crew, the cargo and the voyage itself. The conditions of work for all seafarers around the globe are basically the same, therefore the conditions of employment, manner of work, social security, documents, denunciation of employment contracts (notices), payments and annual leave have been unified through the conventions of the International Labour Organization (ILO) and the International Maritime Organization (IMO), and through the work of the ITF and the European social dialogue. The validation of the newest ILO convention – the Maritime Labour Convention - will unify the standards of work and employment to an even greater extent. Slovenia follows the developments in the international community.
