Title:NEZDRUŽLJIVOST POSLANSKE FUNKCIJE Z DRUGIMI JAVNIMI FUNKCIJAMI

Abstract:Pričujoča diplomska naloga temeljito obravnava nezdružljivost poslanske funkcije z drugimi javnimi funkcijami. Za razumevanje instituta nezdružljivosti je pomembno načelo delitve oblasti na zakonodajno, izvršilno in sodno, ki ga v nalogi podrobno predstavim. Diplomsko delo bralcu sistematično predstavi institut nezdružljivosti in ga osvetli z različnih zornih kotov. Tako so v uvodnih poglavjih navedene nekatere splošne značilnosti našega ustavnega sistema, opredelitev javnih funkcionarjev in nekatera teoretična ter zgodovinska izhodišča o nezdružljivosti funkcij. Nato so po posameznih poglavjih nazorno predstavljeni posamezni primeri nezdružljivosti, na koncu pa je predstavljen institut neizvoljvosti in nekatere druge omejitve za funkcionarje. Diplomska naloga podrobno obravnava nezdružljivost poslanske funkcije s funkcijo predsednika države, člana državnega sveta, predsednika vlade, ministra, sodnika ustavnega sodišča, sodnika, državnega tožilca itd. Eno izmed ključnih poglavij je zagotovo poglavje o nezdružljivosti funkcije poslanca s funkcijami v lokalni skupnosti. Predvsem je sporno, ker slovenska ustava in zakonodaja dopuščata, da ista oseba hkrati opravlja funkcijo poslanca in župana. Skozi nalogo ugotovimo, da pozitivna zakonodaja v Republiki Sloveniji dopušča poslancem hkratno opravljanje več (nezdružljivih) funkcij, kar je v nasprotju s pravno teorijo in primerjalno prakso. Zakonska in ustavna podlaga za nezdružljivost poslanske funkcije je pomanjkljiva in bi jo bilo potrebno dopolniti. Položaj poslanca je svoboden (avtonomen) in tudi to onemogoča, da bi se poslanca sankcioniralo. Funkcija poslanca in župana je nezdružljiva, zato bi bilo potrebno to področje urediti drugače.

Title:INCOMPATIBILITY OF MEMBER OF PARLIAMENT WITH OTHER PUBLIC OFFICIES
Abstract:This degree dissertation thoroughly discusses incompatibility of Member of parliament with other public offices. For understanding the institute of incompatibility is important the principle of division of the authority on legislative, executive and judicial which is detailed in my dissertation. The degree dissertation sistematically presents to a reader the institute of incompatibility considering different points of view. Thus are in the introductory chapters quoted some general characteristics of our constitutional system, the definition of public officials and some theoretical and historical starting-points of incompatibilty. Afterwards are respresented in detail individual examples of incompatiblity in separated chapters. In the end is represented the institute of ineligibility and some other limitations for public officials. The degree dissertation discusses in greater detail incompatibility of Member of parliament with president of the state, senator, prime minister, minister, constitutional court judge, judge, public prosecutor… One of the main chapters is definitely the chapter of incompatibility of member of parliament with the position of mayor. Above all is disputable that Slovenian constitution and legislation allow that one person can be at the same time member of parliament and a mayor. Through the dissertation we ascertain that positive legislation in the Republic of Slovenia allows members of parliament simultaneous practice of more (incompatible) offices which is in opposition to theory of law and comparative practice. Legal and constitutional grounding for the incompatibility of member of parliament is deficient and it should be supplemented. The position of member of parliament is independent (autonomous) and that also prevents that he is sanctioned. The position of member of parliament and mayor is incompatible therefore this field shoud be settled otherwise.
