Title:Razmerje med mednarodnim humanitarnim pravom in človekovimi pravicami : prepletanje pravnih okvirov za zaščito človeškega dostojanstva

Abstract:Mednarodno humanitarno pravo, tudi znano kot vojno pravo, je pravni okvir, ki ureja ravnanje držav in oboroženih skupin med oboroženimi spopadi. Njegov namen je zagotoviti zaščito žrtev vojnega nasilja, zmanjšati trpljenje in ohranjati temeljne človeške vrednote, ne glede na naravo konflikta. Mednarodno humanitarno pravo določa pravila in načela, ki urejajo ravnanje med oboroženimi spopadi ter zagotavljajo zaščito ranljivih posameznikov, kot so civilisti, vojni ujetniki in ranjenci. Prav tako ureja uporabo sile, varovanje civilnega prebivalstva, humanitarni dostop, zaščito vojnih ujetnikov in druge pomembne vidike, ki jih je treba upoštevati v oboroženem konfliktu. Človekove pravice predstavljajo univerzalne pravice, ki pripadajo vsakemu posamezniku ne glede na okoliščine. Temeljijo na ideji, da imajo vsi ljudje neodtujljivo pravico do življenja, svobode, nedotakljivosti in enakega dostojanstva. Človekovo dostojanstvo se povezuje z idejo človekovih pravic, saj je temeljno za spoštovanje in uresničevanje teh pravic. Mednarodni dokumenti priznavajo, da je človekovo dostojanstvo ključno za vzpostavitev demokracije in pravne države ter da so vsi ljudje rojeni svobodni in enaki v dostojanstvu in pravicah. Pravna podlaga za zaščito človekovih pravic obsega Splošno deklaracijo človekovih pravic, Mednarodni pakt o državljanskih in političnih pravicah ter Mednarodni pakt o ekonomskih, socialnih in kulturnih pravicah. Kljub ločenosti mednarodnega humanitarnega prava in človekovih pravic ju je treba razumeti in uporabljati skupaj, saj imata skupen cilj zaščititi človeško dostojanstvo in zagotoviti človekove pravice v različnih kontekstih, vključno v obdobju oboroženih spopadov. Prepletanje obeh pravnih okvirov se kaže na več načinov. Mednarodno humanitarno pravo dopolnjuje človekove pravice v oboroženih konfliktih, pri čemer morajo biti omejitve načela nedotakljivosti življenja sorazmerne in skladne z mednarodnimi človekovimi pravicami. Prav tako mednarodno humanitarno pravo priznava posebne potrebe in ranljivosti civilnega prebivalstva ter določa posebna pravila za njihovo zaščito, kar je v skladu s človekovimi pravicami.

Title:The relationship between international humanitarian law and human rights: the ǂinterplay of legal frameworks for the protection of human dignity : magistrsko delo
Abstract:International humanitarian law, also known as the law of war, is a legal framework that governs the conduct of states and armed groups during armed conflicts. Its purpose is to ensure the protection of victims of war violence, reduce suffering, and uphold fundamental human values regardless of the nature of the conflict. International humanitarian law establishes rules and principles that govern conduct during armed conflicts and provide protection for vulnerable individuals, such as civilians, prisoners of war, and the wounded. It also regulates the use of force, the protection of civilian populations, humanitarian access, the protection of prisoners of war, and other important aspects that must be considered in an armed conflict. Human rights represent universal rights that belong to every individual, regardless of circumstances. They are based on the idea that all people have an inherent right to life, freedom, integrity, and equal dignity. Human dignity is connected to the concept of human rights as it is fundamental to the respect and realization of these rights. International documents recognize that human dignity is essential for establishing democracy and the rule of law, and that all individuals are born free and equal in dignity and rights. The legal basis for the protection of human rights includes the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social, and Cultural Rights. Despite the separation between international humanitarian law and human rights, they need to be understood and applied together as they share the common goal of protecting human dignity and ensuring human rights in different contexts, including periods of armed conflict. The intertwining of both legal frameworks is manifested in several ways. International humanitarian law complements human rights in armed conflicts, with limitations on the principle of the inviolability of life being proportional and consistent with international human rights. Similarly, international humanitarian law recognizes the specific needs and vulnerabilities of the civilian population and establishes specific rules for their protection, which is in line with human rights.
