Title:Pravna zaščita in izzivi varstva človekovih pravic prisilno hospitaliziranih oseb v sloveniji : magistrsko delo

Abstract:Prisilna hospitalizacija oseb z duševnimi motnjami predstavlja enega najresnejših posegov v človekove pravice, saj med drugim omejuje tudi pravico do osebne svobode in telesne integritete. Magistrsko delo preučuje pravno ureditev prisilne hospitalizacije v Sloveniji in njeno skladnost z mednarodnimi standardi. Mednarodna in nacionalna zakonodaja določata vrsto norm in zaščitnih ukrepov v zvezi s prisilno hospitalizacijo. Zakonodaja namreč v določenih okoliščinah dovoljuje odvzem prostosti osebam z duševno motnjo. Poseben poudarek je na pogojih za prisilno hospitalizacijo ter pravnih sredstvih, ki so osebam na voljo za zaščito njihovih pravic. Analiza nacionalne zakonodaje in sodne prakse Evropskega sodišča za človekove pravice kaže, da je slovenska ureditev načeloma skladna z mednarodnimi standardi. Magistrsko delo ugotavlja, da je prisilna hospitalizacija dopustna le kot skrajni ukrep (ultima ratio), pri čemer mora biti podvržena sodnemu nadzoru.

Title:Legal protection and challenges to the protection of human rights of involuntarily hospitalised persons in slovenia
Abstract:Forced hospitalisation of people with mental disorders constitutes one of the most serious interferences with human rights, as it restricts, among other things, the right to personal liberty and physical integrity. The master thesis examines the legal regulation of involuntary hospitalisation in Slovenia and its compliance with international standards. International and national legislation provides for a range of norms and safeguards in relation to involuntary hospitalisation. In fact, the legislation allows for the deprivation of liberty of persons with a mental disorder in certain circumstances. Particular emphasis is placed on the conditions for involuntary hospitalisation and the legal remedies available to persons to protect their rights. An analysis of national legislation and the case law of the European Court of Human Rights shows that Slovenian legislation is in principle in line with international standards. The master's thesis concludes that involuntary hospitalisation is admissible only as a measure of last resort (ultima ratio) and must be subject to judicial review.
