Title:Interna navodila po zakonu o javnih naročilih in izjeme : diplomsko delo

Abstract:Pod javna naročila opredeljujemo vsa naročila, ki jih izvajajo državni organi, organi samoupravnih lokalnih skupnosti, javni zavodi, javna podjetja. Javno naročilo je vsakršno naročilo blaga, storitev ali gradnje, ki ga ustanova izvede in ki so nujno potrebna za njihovo delovanje. Seveda, ob upoštevanju Zakona o javnih naročilih (ZJN – 3), je ključno slediti osrednjim načelom, ki zavezujejo naročnike, kot so gospodarnost, učinkovitost, transparentnost, enakopravnost in sorazmernost. Obstaja tudi možnost prilagoditve svojih pravilnikov znotraj Zakona o javnih naročilih, ki zaostruje pogoje naročanja v določeni ustanovi. Pravilnik se pripravi na podlagi ZJN – 3, vendar dodatno specificira pogoje za naročnika. Vse se spremeni, v kolikor pride do naravne ali druge nesreče. V teh primerih za naročilo blaga, storitve ali gradnje naročnik ne more postopati po ZJN – 3 zaradi nujnosti, življenjsko in premoženjsko ogrožajočih posledic, do katerih bi lahko naravna ali druga nesreča privedla. V teh primerih se izvede naročilo blaga, storitve ali gradnje pri dobavitelju, kjer je glavni pogoj čim prejšnja zagotovitev blaga ali izvedba storitve. Naročilo mora biti izvedeno čim prej, da se lahko zagotovijo osnovni pogoji za življenje ter prepreči nadaljnja nevarnost. V diplomskem delu bomo predstavili javna naročila ter njihov pomen v javnem sektorju, se osredotočili na prednosti in slabosti pri javnih naročilih po izjemi. Predstavili veljavno zakonodajo za izvedbo teh javnih naročil ter analizirali primere javnih naročil oziroma naročil blaga in storitev v primeru naravnih ali drugih nesreč v Mestni občini Maribor. V samem diplomskem delu bomo na podlagi primerov naravnih ali drugih nesreč v Mestni občini Maribor raziskali, kakšna je bila poraba sredstev, kateri so bili ponudniki ter kakšna je bila pravna podlaga za izvedbo storitev oziroma dobavo blaga. Prav tako bomo raziskali, katere obrazce je potrebno izpolniti, iz katerega proračunskega vira se črpajo sredstva in na podlagi česa jih občina pridobi.

Title:Internal instructions according to ZJN and exceptions [i. e. Internal instructions of the public procurement act and exceptions]
Abstract:Under public procurement we define all procurements carried out by state bodies, bodies of self-governing local communities, public institutions, public companies. A public procurement is any procurement of goods, services or construction carried out by an institution that is absolutely necessary for its operation. Of course, according to the main principles that bind clients, namely economy, efficiency, transparency, equality and proportionality, taking into account the Public Procurement Act (ZJN-3). There is also the possibility of adjusting its regulations within the Public Procurement Act, which tightens the conditions of ordering in a certain institution. The rules are prepared on the basis of ZJN-3, but additionally specify the conditions for the client. Everything changes in the event of a natural or other disaster. In these cases, for the order of goods, services or construction, the client cannot proceed according to ZJN-3, due to the urgency, life- and property-threatening consequences that a natural or other disaster could lead to. In these cases, an order for goods, services or construction is made from the supplier, where the main condition is the provision of the goods or the performance of the service as soon as possible. The order must be implemented as soon as possible in order to ensure the basic conditions for life and to prevent further danger. In the thesis, we will present public procurement and its importance in the public sector, focusing on the advantages and disadvantages of public procurement by exception. Presented the applicable legislation for the implementation of these public procurements and analyzed cases of public procurement or procurement of goods and services in the event of natural or other disasters in the Municipality of Maribor. In the thesis itself, we will investigate, based on cases of natural or other disasters in the Municipality of Maribor, what was the use of funds, who were the providers and what was the legal basis for the provision of services or the supply of goods. We will also investigate which forms need to be filled in, and from which budgetary source the funds are drawn and on what basis the municipality obtains them.
