Title:Primerjava pravnega okvirja kaznivih dejanj in otrokovih pravic v slovenski in hrvaški zakonodaji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo z vidika mednarodnih virov in zgodovine urejanja pravic otrok ter vsebinske primerjave kazenskega zakonika v Sloveniji in na Hrvaškem raziskali pravni okvir varstva pravic otrok in mladoletnikov ter sodne prakse v primerih, ko so otroci in mladoletniki žrtve zoper njih storjenih kaznivih dejanj in ko so sami v vlogi storilca. Ugotovili smo, da so otroci in mladoletniki najpogosteje žrtve kaznivih dejanj nasilja v družini, zanemarjanja in surovega ravnanja, onemogočanja stikov drugega starša z otrokom razvezanih staršev, neplačevanja preživnine, kaznivih dejanj spolnega napada na osebo, mlajšo od 15 let, pornografskih vsebin z otroki, posilstva, spolnega nasilja, kršitve spolne nedotakljivosti z zlorabo položaja in pridobivanja oseb, mlajših od 15 let, za spolne namene. Najpogostejša kazniva dejanja, ki jih storijo mladoletniki, so kazniva dejanja zoper premoženje, zoper življenje in telo, javni red in mir, zoper človekovo zdravje in kazniva dejanja zoper spolno nedotakljivost. Ugotovili smo, da se delež kaznivih dejanj mladoletnikov zoper spolno nedotakljivost v vseh storjenih kaznivih dejanjih mladoletnikov v Sloveniji in na Hrvaškem vsako leto poveča v povprečju za 0,2 %. Zaključimo lahko, da so pravice otrok in mladoletnikov tako na mednarodnem nivoju kot na nivoju članic Evropske unije, Slovenije in Hrvaške, dobro urejene. V Sloveniji celovito zagotavlja pravice otrok in mladoletnikov v sodnih postopkih s strokovnjaki, ki te pravice izvajajo v praksi, Zakon o zaščiti otrok v kazenskem postopku in njihovi celostni obravnavi v hiši za otroke.

Title:Comparison of the legal framework of criminal acts and children's rights in Slovenian and Croatian legislation
Abstract:In the thesis, we investigated the legal framework for the protection of the rights of children and minors and judicial practice in cases where children and minors are victims of crimes committed against them and when they themselves are in the role of the perpetrator from the point of view of international sources and the history of regulating children's rights, as well as a substantive comparison of the Criminal Code in Slovenia and Croatia. We found that children and minors are the most frequent victims of criminal acts of domestic violence, neglect of minors and cruel treatment, preventing the contact of the other parent with the child of divorced parents, non-payment of child support, criminal acts of sexual assault against a person under the age of 15, pornographic content with children, rape, sexual violence, violations of sexual integrity through abuse of position and obtaining persons under the age of 15 for sexual purposes. The most common crimes committed by minors are crimes against property, against public order and peace, against human health, against life and body and crimes against sexual untouchability. We found that the share of minors' crimes against sexual untouchability in all crimes committed by minors in Slovenia and Croatia increases by around 0.2% each year. We can conclude that the rights of children and minors are well regulated both at the international level and at the level of the European Union members, Slovenia and Croatia. In Slovenia, it comprehensively ensures the rights of children and minors in court proceedings with experts who implement these rights in practice, Protection of Children in Criminal Procedure and their Comprehensive Treatment in Children's House Act.
