Title:Nezamenljivi žetoni - nova oblika varnosti ali nova oblika kriminalitete zoper umetnine : magistrsko delo

Abstract:Nezamenljivi žetoni (NFT) so edinstvena digitalna sredstva, ki predstavljajo lastništvo predmetov v digitalnem svetu kot so umetnine, zbirateljski predmeti in virtualno blago. S pomočjo veriženja blokov zagotavljajo avtentičnost in provenienco, ter revolucionirajo koncept lastništva v digitalni dobi. S svojo zmožnostjo zagotavljanja preverljivega in nespremenljivega zapisa o lastništvu, NFT-ji pripomorejo k načinu preverjanja pristnosti in varovanju ne samo digitalnih temveč tudi fizičnih umetnin, kar lahko v prihodnosti prispeva k varnosti in transparentnosti na tradicionalnem umetniškem trgu. Na drugi strani, hiter razvoj ekosistema NFT-jev predstavlja nove izzive, vključno z varnostnimi pomisleki, regulatornimi negotovostmi in novimi priložnostmi za izvajanje, beloovratniške kriminalitete, finančne kriminalitete, kibernetske kriminalitete in kriminalitete zoper umetnine. Konvergenca nezamenljivih žetonov in beloovratniške kriminalitete, pri čemer v osprednje spada pranje denarja, predstavlja priložnosti za vključitev nezakonitih sredstev v zakonit finančni sistem, pri čemer se izkorišča anonimnost, ki je ena izmed temeljnih lastosti tehnologije. Nezamenljivi žetoni predstavljajo kompleksno prepletenost tehnoloških, pravnih in ekonomskih vidikov. Celoten ekosistem, vključno z njegovo vrednostjo in vključevanjem v uveljavljene trge pa nakazuje na potrebo po uveljavljanju učinkovitih regulatvnih okvirov, sodelovanju med regulativnimi institucijami in usposobljenimi analitiki verige blokov. Le na ta način se lahko prispeva k zaščiti pred goljufijami, pranjem denarja in drugimi nedovoljenimi dejavnostmi, ter zagotovi da je razvoj NFT-jev usklajen s pravnimi in etičnimi standardi.

Title:Non fungible tokens - a new form of security or a new form of art crime
Abstract:Non-fungible tokens (NFTs) are unique digital assets representing ownership of objects in the digital world such as artwork, collectibles, and virtual goods. Leveraging blockchain technology, NFTs ensure authenticity, and provenance, instigating a paradigm shift in ownership dynamics in the digital era. Their ability to provide a verifiable and immutable record of ownership helps to authenticate and secure not only digital but also physical artworks, which may contribute to security and transparency in the traditional art market. On the other hand, the rapid development of the NFT ecosystem presents new challenges, including security concerns, regulatory uncertainties, and new opportunities for white-collar crime, financial crime, cybercrime, and art crime. The convergence of non-fungible tokens and white-collar crime, with money laundering at the fore, presents an opportunity to integrate illicit funds into the legitimate financial system, exploiting anonymity which represents one of the fundamental properties of the aforementioned technology. Non-fungible tokens represent a complex intertwining of technological, legal, and economic aspects. The whole ecosystem, including its value and integration into established markets, indicates the need to enforce an effective regulatory framework, cooperation with regulatory institutions, and qualified on-chain analysts. Collaborative efforts are pivotal for fostering a secure environment that thwarts fraud, money laundering, and illicit activities and furthermore ensures the evolution of NFTs adheres to ethical and legal norms.
