Title:Kazensko pravno varstvo pravic delavcev : magistrsko delo

Abstract:Magistrska naloga se osredotoča na varovanje pravic delavcev, in sicer na področju kazenskega prava. Ker vedno znova prihaja do kršitev pravic delavcev, se porajajo vprašanja o morebitnih spremembah zakonodaje, ki ščiti njihove interese. Magistrsko delo vsebuje pregled delovnopravne in analizo kazenskopravne zakonodaje (22. poglavje Kazenskega zakonika, v nadaljevanju KZ-1), ki ščiti interese delavcev. Predstavljeno je, kako delovnopravna zakonodaja vpliva na kazensko pravo in katere posamezne pravice delavcev morajo biti kršene, da lahko govorimo o posameznih kaznivih dejanjih iz 22. poglavja KZ-1. Za kršitev temeljnih pravic delavcev (196. člen KZ-1) je potrebno, da nastopi pravna posledica v obliki delavčevega prikrajšanja njegove pravice. Ena izmed takih pravic je na primer pravica do omejenega delovnega časa 40 ur tedensko, kar se lahko podaljša le v določenih dejavnostih ter v določenih primerih. Glede odgovornosti za kazniva dejanja ugotavljam, da pravne osebe lahko odgovarjajo za vsa kazniva dejanja, ki so navedena v poglavju kaznivih dejanj zoper delovno razmerje in socialno varnost. Da pravna oseba lahko odgovarja, morata biti izpolnjena dva pogoja, in sicer formalni in materialni. Pomembno je poudariti, da naklepa fizične osebe ne moremo enačiti z naklepnim ravnanjem pravne osebe. Niti po temeljni jezikovni razlagi ni možno utemeljiti izenačitve, saj terminološko naklepno ravnanje, ki je v povezavi s pravno osebo, ni enako kot naklep fizične osebe. Razlika je prav tako tudi sistematična. Kot ugotavljam v poglavju o sankcijah, se lahko za kršitev temeljnih pravic delavcev izreče zapor od enega meseca do treh let ter stranska denarna kazen, z omilitvijo denarna kazen, lahko pa se izreče tudi pogojna obsodba. V magistrskem delu predvsem ugotavljam, da bi bilo potrebno vzpostaviti bolj prilagodljiv trg dela, ki bi vodil do večje zaposlenosti, kjer bi iskalci zaposlitve lažje in hitreje našli ustrezno zaposlitev, delodajalci pa enostavneje sprejemali odločitve o novem zaposlovanju in odpuščanju. Prispevek magistrske naloge se odraža predvsem kot kritična presoja in analiza obstoječe delovnopravne in kazenskopravne zakonodaje, ki ščiti pravice delavcev. Prav tako so v delu podani smiselni predlogi, ki lahko pripomorejo k zmanjšanju kršitev obstoječe zakonodaje.

Title:Criminal legal protection of employee´s rights
Abstract:This master's thesis focuses on the protection of employee's rights, specifically in the field of criminal law. Violations of workers' rights recurrently occur, so questions about possible changes in legislation that protect the interests of workers arise. The master's thesis contains an overview of labor law and an analysis of criminal law (Chapter 22 of the Criminal Code, which protects the interests of employees). It is presented how labor law affects criminal law and which individual rights of employees must be violated in order to talk about individual criminal acts from Chapter 22 of the Criminal Code-1. In order to violate the fundamental employee's rights (Article 196 of the Criminal Code-1), it is necessary that there be a legal consequence in the form of depriving the employee of his right. One of such rights is, for example, the right to limited working hours 40 hours per week, which can only be extended in certain activities and in certain cases. Regarding liability for criminal acts, I note that legal entities can be held liable for all criminal acts listed in the chapter on crimes against employment and social security. However, in order for a legal entity to be liable, two conditions must be met, namely a formal and a material one. It is important to emphasize that the intent of a natural person cannot be equated with the intentional conduct of a legal entity. Even according to the basic linguistic interpretation, it is not possible to justify the equalization, because terminologically intentional conduct, which is in connection with a legal entity, is not the same as the intent of a natural person. The difference is also systematic. As I noted in the chapter on sanctions, a violation of the employee's fundamental rights can result in a prison sentence of one month to three years and a fine, with a reduced fine, but a suspended sentence can also be imposed. In my master's thesis, I mainly conclude that it would be necessary to establish a more flexible labor market which would lead to greater employment where job seekers would find suitable employment more easily and quickly and employers would more easily make decisions about new hiring and firing. The contribution of the master's thesis is mainly reflected as a critical assessment and analysis of the existing labor law and criminal law legislation that protects the rights of workers. The master's thesis also contains proposals that can reduce violations of existing legislation.
