Abstract:Intuicija preiskovalcev kaznivih dejanj ni široko obravnavan pojem. Razlagati jo je mogoče kot občutke ali slutnje, ki jih preiskovalci razvijejo s svojimi izkušnjami in usposabljanjem. Policisti se pri sprejemanju odločitev pogosto zanašajo na kombinacijo analitičnih in intuitivnih miselnih procesov. Intuitivni miselni procesi so samodejni, lahkotni in spontani, za njihov razvoj so potrebne izkušnje in zavedno učenje. Z dolgoletnimi izkušnjami v različnih okoljih in situacijah policisti razvijajo strokovno intuicijo, ki jim pomaga pri ocenjevanju tveganj, prepoznavanju groženj in sprejemanju hitrih odločitev. Strokovno intuicijo lahko policisti izpopolnijo predvsem z izkušnjami in izpostavljenostjo različnim scenarijem. Izboljšajo lahko sposobnost zaznavanja subtilnih namigov, vzorcev, sprememb v okolju in sprememb v vedenju ljudi. Intuicija ima lahko ključno vlogo pri izboljšanju situacijske ozaveščenosti in varnosti policistov. Preiskovalci kaznivih dejanj se na intuicijo zanašajo predvsem, kadar je informacij o kaznivem dejanju malo ali na začetku kriminalistične preiskave, v nadaljevanju preiskave se poslužujejo predvsem analitičnega odločanja. Vseeno pa je pomembno opozoriti, da intuicija preiskovalcev kaznivih dejanj ni nezmotljiva, potrebno jo je podpreti z analitičnimi miselnimi procesi, upoštevanjem postopkov in spoštovanjem pravic posameznika. Čeprav se raba intuicije lahko izkaže kot koristna, je podvržena iluzijam, hevristikam in pristranskosti. Prekomerna raba intuicije privede do nenatančnih kriminalističnih preiskav, kar vodi do napačne identifikacije osumljenca, neprijetja dejanskega storilca in na koncu do napačnih obsodb. Odločitve, sprejete na podlagi intuicije, je potrebno oceniti in utemeljiti v okviru pravnih in etičnih standardov.

Title:The intuition of crime investigators
Abstract:The intuition of crime investigators is not a widely discussed concept. Criminal investigators' intuition can be interpreted as gut feelings or hunches that investigators develop through their experience and training. Investigators often rely on a combination of analytical and intuitive thought processes. Intuitive thought processes are automatic, easy, and spontaneous. They require experience and conscious learning to develop. In different environments and situations, police officers develop expert intuition that helps them assess risks, identify threats, and make quick decisions. The professional intuition of crime investigators can be improved through experience and exposure to different scenarios. They can enhance their intuition by detecting subtle clues, patterns, changes in their surroundings and changes in peoples' behaviour. Intuition plays a key role in improving situational awareness and the safety of crime investigators. Criminal investigators rely on intuition mainly when information about the crime is scarce or at the beginning of a criminal investigation. As the investigation progresses, they use analytical decision-making. Although intuition is extremely useful in crime investigations, it is important to note that the intuition of criminal investigators is not infallible and needs to be reinforced by analytical thought processes, following procedures and respect for the rights of an individual. Although the use of intuition can prove to be useful, it is subjected to illusions, heuristics, and biases. Overuse of intuition leads to inaccurate criminal investigations, which leads to misidentification of the suspect, non-apprehension of the actual perpetrator and ultimately to wrongful convictions. Decision based on intuition must be evaluated and justified within the framework of legal and ethical standards.
