Title:Odprta pravna in etična vprašanja glede legalizacije medicinske konoplje za uporabo v paliativni oskrbi : magistrsko delo

Abstract:Konoplja velja za učinkovito rastlino, ki se lahko uporablja v prehrambni, industrijski in medicinski panogi. Njene pozitivne učinke so potrdile tudi določene raziskave ter tako pripomogle k postopni legalizaciji konoplje, ki je potekala na mednarodni, evropski in nacionalni ravni. Uporaba konoplje se je tako zakonsko uredila za medicinske, znanstveno-raziskovalne in učne namene. Ob delni zakonski ureditvi uporabe konoplje pa se postavi vrsto pravnih in etičnih vprašanj. Predvsem je za vsakega posameznika pomembno, za katera zdravstvena stanja se bo lahko uporabljala. Različna farmacevtska podjetja so že začela razvijati zdravila na osnovi konoplje, ki lajšajo simptome določenih bolezni, ampak so za posameznika težko dostopna zaradi nacionalnih ureditev, ki določajo avtorizacijo zdravila. Takšna ureditev močno vpliva na terminalno bolne, ki potrebujejo takojšnjo pomoč. Rešitev za takšne bolnike bi bila v legalizaciji gojenja konoplje, saj bi tako hitreje prišli do sestavin, ki so potrebna za zdravila in hkrati zmanjšala odvisnost od uvoza. Takšna ureditev ni samo pri nas, ampak velja za vse članice Evropske unije in podpisnice različnih mednarodnih konvencij. Iz primerjalno pravne analize je razvidno, da v državah članic Evropske unije velja standard, ki ga morajo spoštovati pri urejanju legalizacije konoplje. Za razliko od evropske ureditve, imajo v zvezni državi Kalifornija celovito urejeno področje uporabe, posedovanja in gojenja konoplje za medicinsko in za rekreativno (osebno) uporabo. Poleg pravnih vprašanj se ob urejanju delikatnega področja postavljajo tudi določena etična vprašanja, ki posledično vplivajo na zakonsko ureditev. Predvsem se postavljata dve glavni vprašanji, in sicer kdaj končati zdravljenje terminalnega bolnika in začeti lajšati bolečine in zakaj je konoplja uvrščena pod substance, ki jih je potrebno strogo regulirati, medtem ko so druge substance, ki močno vplivajo na človeško telo, prosto dostopne. Raziskovanje vplivov konoplje na človeško telo je v polnem razsegu, zato bo moralo pravo slediti novim dokazom in celovito urediti to področje. Pomembno je, da bo zakonodajalec ob sprejemanju ali dopolnjevanju zakonov prisluhnil zdravstveni in farmacevtski stroki.

Title:Open legal and ethical questions about legalisation of medical cannabis for use in paliative care
Abstract:Cannabis is considered as an effective plant that can be used for food, industrial and medical purposes. Its positive effects were also confirmed by certain researches that contribute to the legalisation of cannabis on International, European and National level. The use of cannabis has been since then regulated for medical, scientific research and educational use. With the partial legal regulation of the use of cannabis, a series of legal and ethical question arises. Above all, it is important for a person to know for which medical conditions can cannabis be used for. Various pharmaceutical companies have already started to develop cannabis-based drugs that can relieve the symptoms of certain diseases but they are difficult to access for individuals, because of national regulations that determine the authorization of drugs. Such arrangement greatly affects terminally ill people that need immediate help. The solution for such patients would be to legalise the cultivation of cannabis, as this would make it easier to get necessary ingredients for medicines and at the same time they would decrease in terms of imports. Such arrangement is not only in our country, but applies to all members of the European Union and signatories to various international conventions. From the comparetive legal analysis, it is clear that there is a standard forth the member states of the European Union, which they must respect, when they regulate the legalisation of cannabis. Unlike European regulations, in the State of California, they have comprehensively regulated the use, possession and cultivation of cannabis for medical and recreative (personal) use. In addition to legal issues, certain ethical issues also arise when regulating a delicate area, which in turn affect the legal regulation. In particular two main questions arise, namely when to end the terminal patient treatment and start relieving pain and why cannabis is classified as a substance that need to be strictly regulated, while other substances that have a strong effect on the human body are easily accessible. Research into the effects of cannabis on the human body is in progress, so the law institutions will be obliged to follow new evidence and comprehensively regulate this area. It is important that the legislator listens to medical and pharmaceutical profession when they will be adopting or amending laws.
