Title:Analiza pogojev v italijanskih zaporih : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Spoštovanje človekovih pravic je temelj današnje družbe. Da to lahko izpolnimo, moramo razumeti, katere pravice sploh imamo, nadalje pa je na organih države, da te pravice upoštevajo tudi ob odvzemu prostosti. Zapor je okolje, ki omejuje številne pravice. V zaključnem delu predstavljamo mednarodno in nacionalno zakonodaja, ki varuje pravice zapornikov v Italiji. Analiza se osredotoča na italijanske zapore, saj spadajo med ene izmed najbolj zasedenih, slabo vzdrževanih prostorov za zadrževanje zapornikov v Evropi. Italijo pesti predvsem problematika prezasedenosti zaporov, ki negativno vpliva na zagotavljanje osnovnih pogojev v zaporih. Ne samo da prezasedenost negativno vpliva na zdravje, počutje, organizacijo, ampak tudi krši 3. člen Konvencije proti mučenju in drugim krutim, nečloveškim ali poniževalnim kaznim ali ravnanju, kar je ugotovilo Evropsko sodišče za človekove pravice. Stanje v zaporih smo preverili z analizo poročil Odbora za preprečevanje mučenja in nehumanega ter poniževalnega ravnanja ali kaznovanja, SPACE I ter organizacije Antigona. Izsledki kažejo, da se število kršitev, ki jih je zaznal Odbor za preprečevanje mučenja in nehumanega ter poniževalnega ravnanja ali kaznovanja, skozi leta manjša. Analiza pa je pokazala povezanost med prezasedenostjo zaporov in številom kršitev.

Title:Analysis of prison conditions in italy
Abstract:Respect for human rights is the foundation of today's society. To be able to fulfil this, we need to understand what rights we have in the first place, and furthermore, it is up to the state authorities to take these rights into account even when depriving individuals of their liberty. Prison is an environment that restricts many rights. In the diploma thesis, we present the international and national legislation that protects the rights of prisoners in Italy. The analysis focuses on Italian prisons, as they are among Europe's most overcrowded, poorly maintained prisons. Italy is mainly plagued by the problem of prison overcrowding, which negatively affects the provision of basic conditions in prisons. Not only does overcrowding have a negative impact on health, well-being, and organization of prisons, but it also violates Article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, as found by the European Court of Human Rights. We analysed the situation in prisons by analysing the reports of the Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment, SPACE I and the Antigona organization. The findings show that the number of violations detected by the Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment has decreased over the years. Moreover, the analysis showed a connection between prison overcrowding and the number of violations.
