Title:Vloga detektiva pri preiskovanju nezvestobe : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Preiskovanje nezvestobe velja za eno najbolj delikatnih detektivskih opravil, ki vzbuja veliko etičnih in moralnih vprašanj. Ponavadi je to tudi tisto opravilo, zaradi katerega širša javnost detektive pozna. V diplomskem delu je bilo ugotovljeno, da se bodo detektivi tudi v prihodnosti ukvarjali s preiskovanjem nezvestobe, zaradi česar je smiselno pridobiti globlje razumevanje njihove vloge pri tovrstnih primerih. Samo javno mnenje o delu detektiva pa je v Republiki Sloveniji precej popačeno in v veliki meri temelji na gledanju televizijskih nanizank ter filmov. Diplomsko delo se osredotoča tudi na nevarnosti, ki jim je detektiv pri tovrstnih primerih izpostavljen. Ugotovitve imajo podlago v intervjujih in anketi s slovenskimi detektivi, ki opisujejo detektivsko delo kot stresno, naporno, nepredvidljivo, razburljivo, nevarno in dinamično. Samo preiskovanje pa je velikokrat oteženo zaradi najrazličnejših omejitev, kjer izstopa pričakovana zasebnost. Detektiv mora pri preiskovanju nezvestobe reagirati hitro, a previdno, da ne prekorači mej zakonitosti. Samega povpraševanja po detektivih za preiskovanje nezvestobe je v Republiki Sloveniji veliko, kar pomeni, da imajo detektivi s tem veliko dela, pa tudi zaslužka. Pri mednarodni primerjavi je bilo ugotovljeno, da se države razlikujejo predvsem v tem, da dokazi o nezvestobi ponekod vplivajo na postopke sodišč, podrugod pa ne. Veliko razlik pa se je pokazalo tudi pri uporabi tehničnih sredstev. Hrvaški detektivi lahko uporabljajo sledilno napravo, v drugih proučevanih državah pa se tega ne sme. Za razliko od slovenskih detektivov, imajo hrvaški in ameriški celo pravico do hrambe in nošenja orožja. Ugotovljeno pa je bilo, da je detektivsko preiskovanje nezvestobe v vseh primerjanih državah prisotno v veliki meri.

Title:The role of private detective in investigating infidelity
Abstract:Investigating infidelity is considered one of the most delicate things of detective's tasks, which raises many ethical and moral questions. Investigating infidelity is also usually the task that makes the detective known to the general public. This diploma paper concluded that detectives will continue to be involved in investigating infidelity in the future, which makes it worthwhile to gain a deeper understanding of their role in such cases. The public opinion of detective work in Slovenia is quite distorted and is largely based on watching TV series and films. This diploma paper also focuses on the dangers to which the detective is exposed in such cases. The findings of this paper are based on interviews and a survey with Slovenian detectives, who describe detective work as stressful, tiring, unpredictable, exciting, dangerous and dynamic. The investigation itself is often hampered by a variety of restrictions, where the expectation of privacy stands out in particular. When investigating infidelity, the detective must react quickly but carefully so as not to overstep the bounds of legality. The demand for detectives to investigate infidelity is high in Slovenia, which means that detectives have a lot of work to do and a lot of money to earn. The international comparison found that countries differ mainly in the way that evidence of infidelity affects court proceedings. However, there were also many differences in the use of technical means. Croatian detectives can use a tracking device, which is forbidden in other studied countries. Unlike Slovenian detectives, Croatian and American detectives even have the right to keep and bear arms. Detective investigation of infidelity was found to be present to a large extent in all the countries compared.
