Title:Ureditev komunikacijskih storitev OTT na področju elektronskih komunikacij v pravu EU : magistrsko delo

Abstract:Komunikacijske storitve OTT, ki se uporabljajo za komunikacijo in se navadno ponujajo preko aplikacij so doživele izjemen razvoj. Ker jih evropski zakonodajni sveženj na področju elektronskih komunikacij iz leta 2002 ni urejal, so mnogi v njih videli slepe potnike elektronskih komunikacijskih omrežij, ki konkurirajo tradicionalnim elektronskim komunikacijskim storitvam, kot so govorna telefonija in SMS sporočila. Kot plod tega je nastala Direktiva o Evropskem zakoniku o elektronskih komunikacijah, kot novelacija štirih direktiv na področju elektronskih komunikacij, katere eden od glavnih ciljev je bil normirati komunikacijske storitve OTT. Poleg Evropskega zakonika o elektronskih komunikacijah, ureja področje elektronskih komunikacij tudi Direktiva o zasebnosti in elektronskih komunikacijah, sprejeta v okviru evropskega zakonodajnega svežnja elektronskih komunikacij iz leta 2002 in normira obdelavo osebnih podatkov in varstvo zasebnosti na področju elektronskih komunikacij. Čeprav še vedno veljavna, predstavlja anahronizem ureditve, ki ne zajema komunikacijskih storitev OTT. Kot rešitev problema je nastal predlog Uredbe o zasebnosti in elektronskih komunikacijah, ki čaka na sprejetje. Magistrska naloga predstavlja problematiko opredelitve komunikacijskih storitev OTT z relevantno sodno prakso in njihovo trenutno ureditev v Direktivi o Evropskem zakoniku o elektronskih komunikacijah ter primerjavo ureditve med vrstami komunikacijskih storitev OTT in tradicionalnimi elektronskimi komunikacijskimi storitvami. Predstavljena je tudi trenutna ureditev varstva osebnih podatkov na področju elektronskih komunikacij z vidika komunikacijskih storitev OTT ter njihova bodoča ureditev v predlogu Uredbe o zasebnosti in elektronskih komunikacijah. V magistrski nalogi zaključujem, da vseh komunikacijskih storitev OTT ni moč metati v isti koš. Glede na ponujeno storitev se razlikuje tudi njihovo normiranje. Komunikacijske storitve OTT, ki se povezujejo v elektronska komunikacijska omrežja, so v večji meri izenačena s tradicionalnimi elektronskimi komunikacijskimi storitvami. Na drugi strani zadevajo komunikacijske storitve OTT, ki se ne povezujejo v omrežja, v grobem, zgolj določbe o varstvu končnih uporabnikov. Na področju varstva osebnih podatkov elektronskih komunikacij trenutno obstaja pravna praznina, saj večina komunikacijskih storitev OTT ni urejenih. Predlog Uredbe o zasebnosti in elektronskih komunikacijah v trenutni različici v skoraj vseh določbah izenačuje tradicionalne elektronske komunikacijske storitve in komunikacijske storitve OTT.

Title:EU regulation of OTT communication services in electronic communications sector
Abstract:The OTT communication services used for communication that are usually provided through applications have evolved considerably. As they were not regulated by the EU electronic communications legislative package of 2002, many saw them as free riders on electronic communications networks that are competing with traditional electronic communications services such as voice telephony and text messaging. As a result, the Directive establishing the European Electronic Communications Code was passed, as a recast of previous four directives in the electronic communications sector. One of its main objectives was regulation of OTT communication services. In addition to the European Electronic Communications Code, the electronic communications sector is also regulated by the Directive on privacy and electronic communications, adopted within the framework of the European electronic communications package of 2002, that regulates processing of personal data and the protection of privacy in the electronic communications sector. Although still in force, it represents an anachronism that does not cover OTT communication services. As a solution, a proposal for a Regulation on Privacy and Electronic Communications is in process of adoption. This master's thesis presents the issue of defining OTT communication services with relevant case law and their current regulation in the European Electronic Communications Code with comparison of regulation between types of OTT communication services and traditional electronic communications services. It also presents their current regulation of personal data protection in the electronic communications sector and their future regulation in the proposal for a Regulation on Privacy and Electronic Communications. In this master's thesis I conclude that not all OTT communication services are the same. Depending on the service offered, their regulation differs. OTT communication services, which connect to electronic communications networks are largely equated with traditional electronic communications services. On the other hand, regulation of OTT communication services that do not connect to electronic communication networks is in large part limited to end-user protection provisions. There is currently a legal gap in the field of personal data protection of electronic communications, as most OTT communication services are not regulated. The current version of the proposal for a Regulation on privacy and electronic communications equates traditional electronic communications services with OTT communications services in almost all provisions.
