Title:Inkriminacija lažnih novic in sovražnega govora po socialnih medijih : magistrsko delo

Abstract:V magistrski nalogi smo se spopadli s težavo širjenja lažnih novic v socialnih medijih in kazenske odgovornosti za takšno dejanje. V modernem svetu, kjer je dostopnost do socialnih medijev skrajno nenadzorovana (tudi s strani staršev), se pojavljajo razne novice (resnične in neresnične) kot posledica mednarodno zagotovljene pravice do svobode izražanja. Vzporedno s tem se na socialnih medijih pojavlja vedno več lažnih računov, preko katerih se širijo lažne novice in sovražni govor. Hkrati se poraja vprašanje pravne odgovornosti glede pisanja le teh novic in takšnih oblik govora. Nekaj pravnih pravil nam navaja že sama zakonodaja, nekaj pa nam določajo sodišča preko sodne prakse. Problem je kakorkoli gledamo ne samo v Sloveniji, ampak tudi drugod po svetu, kajti tematika obdelana v tej nalogi ni nova, je pa nenadzorovana oz. premalo nadzorovana. Se pa v vsakem obdobju zgodovine srečamo s težavo ali urediti neko pravno področje, in za kakšno ceno, ali ga pustiti neurejeno in preko sodne prakse in pravne analize reševati zadeve za vnaprej.

Title:Incrimination of fake news and hate speech on social media
Abstract:In this Master's thesis the issue of spreading fake news on social media in the light of an unlawful act will be recognised. In the modern world, where access to social media is extremely uncontrolled (including by parents), various news (true and untrue) is emerging as a result of the internationally guaranteed right to freedom of expression. At the same time, more and more fake accounts are appearing on social media, through which fake news and hate speech are spreading. At the same time, legal question of legal responsibility arises regarding who will be held responsible for writing these kinds of news and such forms of speech. Some legal rules are already stated by the legislators, and some are determined by the courts through case law. No matter how we try to approach this topic, the problem is not only in Slovenia, but also it is a global issue. The topic covered in this paper is not new, but it is uncontrolled or insufficiently controlled. No matter what we do, in every period of history we look into we face the same problem of whether to regulate a certain legal field, and at what cost. Or is it better to leave it unregulated and to resolve matters in advance through case law and legal analysis.
