Title:Sodna preiskava in smotrnost njene umeščenosti v kazenski postopek : magistrsko delo

Abstract:Vprašanje prenove modela predhodnega postopka je bolj ali manj aktualno že vse od leta 2003, saj si je od takrat skoraj vsaka vlada prizadevala za odpravo sodne preiskave in uvedbo preiskave, ki bi potekala pod okriljem državnega tožilca, t. i. tožilske preiskave. Navedenim težnjam po ukinitvi sodne preiskave je botrovala vse večja želja po uvedbi učinkovitejšega in hitrejšega kazenskega postopka. Z ukinitvijo sodne preiskave in instituta preiskovalnega sodnika bi sledili večini evropskih držav, ki so model sodne preiskave zamenjale za preiskavo, katere dominus litis je državni tožilec. Trenutni sodni zaostanki in dolgotrajne sodne preiskave v postopkih gospodarskega kriminala so gotovo rdeča luč, ki opozarja, da so določene spremembe potrebne. Kar se zdi pri tehtanju glede ohranitve sodne preiskave pomembno, je predvsem razjasnitev pojma !učinkovitost! v zvezi s predhodnim postopkom in dognanje kako doseči učinkovit postopek. Če sploh kako. Dva odmevnejša predloga Zakona o kazenskem postopku, ki sta želela uvesti tožilsko preiskavo in korenito reformirati kazensko proceduro, sta naletela na neodobravanje pravne stroke. Glede na navedeno je zaenkrat primerneje predhodni postopek spreminjati postopoma in sistematično, kot pa popolnoma menjati model postopka. Ukinitev sodne preiskave namreč ni nobeno jamstvo za učinkovitejši, predvsem pa krajši postopek saj se zaenkrat zdi skoraj nemogoče pričakovati, da bi si organi pregona prizadevali za objektivno raziskanje vseh okoliščin kaznivega dejanja, kar bi znalo znatno vplivati na močno podrejen položaj osumljenca v kazenskem postopku.

Title:Judicial investigation and the expediency of its involvment in criminal proceedings
Abstract:The question of reforming the preliminary proceedings model has been more or less on the agenda since 2003, when almost every government since then has sought to abolish the judicial inquiry and introduce an investigation under the aegis of the public prosecutor, the so-called prosecutorial inquiry. This drive to abolish the judicial inquiry has been driven by a growing desire to introduce more efficient and faster criminal proceedings. The abolition of the judicial inquiry and the institution of the investigating judge would follow the majority of European countries which have replaced the model of the judicial inquiry with an inquiry whose dominus litis is the public prosecutor. The current backlog of court cases and the lengthy judicial investigations in economic crime cases are certainly a red light that certain changes are needed. What seems to be important when weighing up whether to maintain the judicial inquiry is, above all, to clarify the notion of 'efficiency' in relation to the preliminary procedure and to find out how to achieve an efficient procedure. If at all. Two of the more high-profile proposals in the Criminal Procedure Act, which sought to introduce a prosecutorial inquiry and radically reform criminal procedure, met with the disapproval of the legal profession. In the light of the above, it is preferable at this stage to change the preliminary procedure gradually and systematically, rather than to completely change the procedural model. The abolition of the judicial inquiry is no guarantee of a more efficient and, above all, shorter procedure, as it seems almost impossible at this stage to expect the law enforcement authorities to make any effort to investigate objectively all the circumstances of the crime, which could have a significant impact on the suspect's highly subordinated position in the criminal proceedings.
