Title:Pravni vidiki osamosvajanja Slovenije : magistrsko delo

Abstract:Republika Slovenija je bila kot država utemeljena že v času Avnojskih sklepov in dogovorov o nastanku druge Jugoslavije. S sprejemom zvezne jugoslovanske ustave in posledično republiških, je Slovenija prostovoljno, na podlagi pravice do samoodločbe narodov, del svojih suverenih pravic prenesla v izvrševanje na federalno raven. Ta pravna izhodišča so bila pomembna ob koncu osemdesetih, ko se je v Sloveniji pričel proces osamosvajanja. Politika, še v času socializma, je z ustavnimi amandmaji in izvedbenimi pravnimi akti poskrbela, da je slovensko pot do samostojnosti najprej utemeljila na pravnih dejstvih. Za ta korak, ima kot ena od dejavnikov osamosvajanja, pomembne zasluge tudi zveza komunistov in njena vloga pri delovanju slovenske skupščine. Vse te pravne podlage so vrhunec dosegle ob izvedbi zgodovinskega plebiscita za samostojnost in neodvisnost Slovenije, s katerim je slovensko ljudstvo političnim oblastem naložilo, da morajo pripraviti vse aktivnosti za uspešno razglasitev samostojnosti in neodvisnosti države. Za ta korak se je bilo potrebno pripraviti tudi v smislu zavarovanja pravnih odločitev. Zato so bili pomembna tudi pravna dejanja na področju obrambe in prevzema slovenske jurisdikcije nad lastnim sistemom obrambno-varnostnih sil. Samo na tak način je Slovenija uspešno zavarovala suverenost ter obranila neodvisnost in samostojnost. Pri raziskovanju pravnih podlag za vojaško agresijo junija 1991 v Sloveniji, se poraja zanimivo vprašanje, na kakšnih pravnih osnovah je v Sloveniji posredovala JLA. Raziskovalno delo zajema analizo teh dejstev, pristojnosti zveznih organov na tem področju ter vprašanje obsega izvrševanja ukaza za vojaško posredovanje JLA v Sloveniji.

Title:Legal aspects of Slovenia`s independence
Abstract:Republic of Slovenia had already been established as a state within the Avnoj (Anti-Fascist Council of National Liberation of Yugoslavia) resolution, as well as within the agreements about the formation of second Yugoslavia. With acceptance of federal Yugoslav and consequentially state constitution, Slovenia has voluntarily, based on the right of self-determination of nations, carried part of its sovereign rights for the execution on federal level. These legal grounds were important at the end of the eighties, when an independence process started in Slovenia. The politics, still in time of socialism, provided the constitutional amendments and executive legislation files, which induced Slovenia’s establishment of independence essentially based on legal facts. As one of the factors in independence process, the communist party played an important part regarding its role in the activity of Slovenian assembly. These legal grounds were important in order to enforce the historical plebiscite for independence and autonomy of Slovenia. On the grounds of the plebiscite results, Slovenian nation instructed the political authorities to prepare the activities, necessary for the successful proclamation of state’s independence and autonomy. To achieve this goal, preparations took place to insure legal decisions. In that matter, legal actions in the field of national defense and seizure of the Slovene jurisdiction above own system of defensive-safety forces were important as well. This process was essential to secure Slovenia’s sovereignty and successfully defend its independence and autonomy. Research of legal bases for military aggression in June 1991 poses an interesting question: on which legal grounds the Yugoslav People's Army interfered in Slovenia. Research work contains analysis of mentioned facts, jurisdiction of federal authorities in this field and the question about capacity of executing the orders for military intervention of YPA in Slovenia.
