Title:Primerjava slovenskega in avstrijskega zaporskega sistema : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu je predstavljena primerjava med slovenskim in avstrijskim zaporskim sistemom. Delo se osredotoča na trenutne razmere obeh zaporskih sistemov, pri čemer so poudarjene predvsem podobnosti in razlike teh dveh sistemov ter težave, s katerimi se srečujeta. Slovenija in Avstrija sta bili v preteklosti del skupne države avstro-ogrske monarhije, zato se del diplomskega dela osredotoča tudi na zgodovinski razvoj zaporskih sistemov obeh držav tako v skupni državi kot kasneje po razpadu avstro-ogrske monarhije. Zgodovinskemu razvoju sledi pregled zakonodaje obeh držav, delo se dotakne tudi povratništva, nato sledi pregled podatkov o zaporski populaciji in zaposlenih v posameznem zaporskem sistemu. Pri izdelavi diplomskega dela sta uporabljeni deskriptivna metoda in komparativno-historična metoda, opravljena je tudi primerjalna analiza statističnih podatkov. Primerjava avstrijskega in slovenskega zaporskega sistema pokaže, da se v obeh državah srečujejo s prezasedenostjo zaporov, obenem tudi s kadrovsko stisko, ki negativno vplivata na pogoje za delo in povzročata preobremenjenost. Kljub želji zaprtih oseb po opravljanju dela je v delu ugotovljeno, da v obeh zaporskih sistemih tega ne zagotavljajo v zadostni meri. Težave predstavlja tudi starost nekaterih zaporov v obeh državah, ki prvotno niso bili namenjeni izvrševanju kazni zapora in posledično ne ustrezajo današnjim infrastrukturnim zahtevam. V delu je ugotovljeno, da se med zaporskima sistemoma kažejo razlike pri delu obsojencev, ki je v avstrijskih zaporih (za razliko od slovenskih) obvezno. Glede kaznovalne naravnanosti Slovenija spada med manj kaznovalno naravnane države, medtem ko se Avstrija uvršča med srednje kaznovalno naravnane države. Razlike med slovenskimi in avstrijskimi zapori so tudi v deležu tujcev znotraj zaporov – v Avstriji tuji državljani predstavljajo več kot polovico zaporske populacije v Sloveniji pa slabo tretjino.

Title:Comparison of slovenian and austrian prison systems
Abstract:The bachelor’s thesis presents a comparison between the Slovenian and Austrian prison systems. The main focus is on the current situation of the two prison systems, concentrating on the similarities and differences between the two systems and the problems they face. In the past, Slovenia and Austria were part of the joint state of the Austro-Hungarian monarchy, so part of the thesis also focuses on the historical development of the prison systems of both countries in the joint state and later after the collapse of the Austro-Hungarian monarchy. The part on the historical development is followed by a review of the legislation of both countries, where we focused on recidivism and a review of data on the prison population and prison staff in each of the prison systems. In the bachelor’s thesis, we used descriptive and comparative-historical methods to describe the situation and conditions in both prison systems and comparative analysis of statistical data. The content of the thesis thus offers us an insight into the state of the prison systems, which shows that in both countries, they face prison overcrowding and staff shortages, which negatively affect working conditions and cause burnout of the staff. Despite the desire of prisoners to work, findings showed that this is not sufficiently ensured in both prison systems. The age of some prisons in both countries also poses a problem. They were not originally designed to serve prison sentences and consequently do not meet today’s infrastructure requirements. We find that the prison systems differ mainly in the prisoner’s obligation to work, which is mandatory in Austrian prisons as opposed to Slovenian ones. Slovenia is one of the less punitive-oriented countries, while Austria is one of the medium punitive-oriented countries. There are also differences between Slovenian and Austrian prisons in the share of foreigners within prisons. In Austria, foreigners represent more than half of the prison population, and in Slovenia, just under a third.
