Title:Izbrana pravna vprašanja digitalizacije energetskega sektorja : magistrsko delo

Abstract:Razvoj energetskega sektorja je cilj vsake države na svetu, saj energenti vplivajo na državno varnost, komunikacijo, logistiko in na številne druge družbene podsisteme, ki so nujni za normalno delovanje družbe. Trenutna uporaba konvencionalnih goriv pri proizvodnji električne energije je skozi študije učinkov uporabe pokazala okoljsko škodo in posledice le-te. Delno rešitev pri tem vsekakor predstavljajo ozaveščanje in izobraževanje družbe o učinkih uporabe tradicionalnih goriv ter spodbujanje pri uporabi obnovljivih virov energije (v nadaljevanju OVE). To bi bilo nujno tudi zaradi dejstva, da fosilnih goriv ni neomejeno na voljo in je zato treba narediti energetski prehod, kjer bo večji poudarek na energetski učinkovitosti ob pridobivanju OVE. Trenutna stopnja implementacije novejših digitalnih tehnologij še ni preveč razširjena, zato so morebitni zapleti v praksi še nepoznani. Težavo bodo predstavljali tudi dokazovanje vmesnih procesov tehnologije in vprašanja, ki so povezana s podatki, ki v industriji 4.0 veljajo za ''novo nafto''. Proces digitalizacije energetskega sektorja bo možen le, če bo zato obstajal regulatorni okvir, ki bo omogočal pravno varnost za uporabnike omrežja. V ta namen je Evropska komisija (v nadaljevanju Komisija) pripravila nekatere spodbudne ukrepe za novejše tehnologije v zakonodajnem svežnju Čista energija za vse Evropejce. Digitalizacija je pri energetskem prehodu nujno zlo, če želimo doseči določene cilje iz nekaterih sporazumov in narediti prehod iz tradicionalnih fosilnih goriv na OVE ob hkratnem zavedanju, da smo za varnost odgovorni tudi posamezniki. Če želimo uresničiti digitalni energetski prehod, je kljub dobro dodelani teoriji potrebno sodelovanje več držav na tem področju. Določena pravna vprašanja, ki se pojavljajo v energetskem sektorju, se bodo z digitalizacijo prenesla v kibernetski prostor, ki bo težje nadzorovan brez določenih mehanizmov ali aktivnosti uporabnikov energetskega omrežja.

Title:Selected legal aspects of digitalisation in the energy sector
Abstract:The development of the energy sector is the goal of every country in the world, as energy sources affect national security, communication and logistics in other social subsystems, which are necessary for the normal functioning of society. The current use of conventional fuels in electricity generation was demonstrated in the following circumstances during the efficiency study. A partial solution is certainly to raise awareness and educate companies about the efficient use of traditional fuels and to promote the use of renewable energy sources (hereinafter RES). If it were also necessary due to the fact that fossil fuels are not available indefinitely and therefore it is necessary to make an energy transition, where there will be more emphasis on energy efficiency in obtaining RES. The current level of implementation of newer digital technologies is not even too widespread, so the more important complications are still unknown in practice. Another problem will be the demonstration of different process technologies in relation to the data related to the data considered "new oil" in Industry 4.0. The process of digitization of the energy sector will only be possible if proper legal framework exists. To this end, the European Commission has set up some incentive services for new technologies in the new agreement called Clean energy for all Europeans package. Digitalisation is a necessary evil in the energy transition if we want to achieve certain goals from some agreements and make the transition from traditional fossil fuels to RES, while realize that individuals are also responsible for security. If we want to realize the digital energy transition, despite a well-developed theory, the cooperation of several countries in this field is needed. Certain legal issues that arise in the energy sector will be transferred to cyberspace through digitalisation, which will be more difficult to control without certain mechanisms or activities of energy network users.
