Title:Kako izboljšati kazenski pregon gospodarskega kriminala v Sloveniji

Abstract:Namen prispevka: V prispevku se ukvarjam s tremi izključno kazenskopravnimi instrumenti, ki bi bistveno izboljšali učinkovitost kazenskih pregonov gospodarskega kriminala v Sloveniji. Namen prispevka je, v okviru materialnega kazenskega prava, predstaviti institut nepravih opustitev in predlog posebnega kaznivega dejanja prevzema in izčrpavanja kapitalske gospodarske družbe s strani organov vodenja in nadzora. V okviru procesnega kazenskega prava pa je namen predstaviti mehanizem pogajanja tožilca z obdolžencem kaznivega dejanja – angl. plea bargain (sporazum o priznanju krivde). Metode: Prispevek je teoretične narave. Temelji na primerjavi s tujo zakonodajo in spoznanjih anglo-ameriške kazenskopravne stroke in na avtorjevem poznavanju kazenskega zakonika in postopka. Ugotovitve: Posebno kaznivo dejanje prevzema in izčrpavanja kapitalske gospodarske družbe bi bilo potrebno v Kazenski zakonik še vnesti, prav tako pa v Zakon o kazenskem postopku institut plea bargain. Neprave opustitvene oblike izvršitve kaznivih dejanj v Sloveniji že poznamo, namen prispevka pa je na njih posebej opozoriti tudi z vidika pregona gospodarskega kriminala. Učinkovita raba in povezanost vseh treh instrumentov bi pripomogla k bolj učinkovitemu kazenskemu pregonu gospodarskega kriminala, ki danes velja za izredno škodljivo in težko dokazljivo obliko kriminala. Praktična uporabnost: Je ravno v ugotovitvah prispevka. V kolikor bi te bile prevzete v slovensko kazensko zakonodajo in tudi dejansko uporabljene, bi si lahko obetali bolj učinkovit kazenski pregon gospodarskega kriminala, več utemeljenih obtožnic in s tem obsodilnih sodb. Izvirnost/pomembnost prispevka: Prispevek predstavlja nekatere ugotovitve, ki bi jih Slovenija v kazensko zakonodajo morala implementirati z namenom bolj učinkovitega pregona gospodarskih kaznivih dejanj. Ugotovitve so namenjene vsem, ki se ukvarjajo z gospodarskim in kazenskim pravom in tistim, ki problematiko gospodarskega kriminala preučujejo z drugih perspektiv.

Title:How to Improve Criminal Prosecution of Corporate Crime in Slovenia
Abstract:Purpose: In this paper we deal exclusively with the three criminal law instruments, which would significantly improve the effectiveness of criminal prosecutions of corporate crimes in Slovenia. The purpose of this paper is to present, in the context of substantive criminal law, institute of omissions and a new criminal offense of depletion and taking over a capital corporate company by the company's administration. Regarding procedural criminal law, I present an effective mechanism, where the prosecuter can negotiate with criminal defendant about his guilt - plea bargain. Design/Methods/Approach: The article is theoretical in nature. It's based on a comparison with the findings of Anglo-american criminal law experts, foreign penal codes and on the author's knowledge of slovenian penal code and procedure. Findings: Specific offense of depletion and taking over a capital corporate company by it's administration has to be implemented in Slovenian Criminal Code, as well as plea bargain institute in the Criminal Procedure Code. Omissions are already implemented in our Criminal Code, however the intent of this paper is to draw attention to them for the purpose of combating corporate crime. Effective use and integration of all three instruments would lead to more effective prosecution of corporate crime. Practical implications: If the findings of the paper will be implemented in the Slovenian criminal legislation, we can expect a more effective prosecution of corporate crimes in slovenia, better indicments and more successful verdicts. Originality/Value: The paper presents some findings that Slovenia should implement in the criminal law. Should it do so, we should expect a more effective prosecution of corporate crimes in Slovenia. The findings are intended for those who are engaged in corporate and criminal law and to those who are studying corporate crime from other perspectives.
