Abstract:Namen prispevka: Evropska unija predstavlja prostor, kjer je zagotovljena pravica do varnosti. Za to so pristojne številne agencije, predvsem pa policija. Namen prispevka je prikazati instrumente Evropske unije, ki urejajo policijsko sodelovanje pri zagotavljanju notranje varnosti v Evropski uniji. Avtorja izpostavita pomen policijskega sodelovanja, predstavita pravne okvirje, sistemske ukrepe, instrumente in oblike policijskega sodelovanja na ravni Evropske unije. Posebej je izpostavljena vloga Slovenije kot države članice. Na koncu avtorja razpravljata o uspešnosti razvoja policijskega sodelovanja v evropskem prostoru. Metode: Uporabljena je metoda analize vsebine pisnih virov, predvsem pogodbe, strategije, uredbe in drugi akti organov Evropske unije. Avtorja uporabljata pri analizi tudi ugotovitve na podlagi lastnih izkušenj in posamezne oblike policijskega sodelovanja ponazorita tudi s primeri iz slovenske prakse. Ugotovitve: Policijsko sodelovanje v Evropski uniji obsega paket političnih, zakonodajnih, organizacijskih, sistemskih in izvedbenih ukrepov. Razvoj policijskega sodelovanja v zadnjih 20-ih letih je šel predvsem v smeri nenehnega izboljšanja izmenjave policijskih informacij in podatkov, nikakor pa ne v smer prenosa preiskovalnih in policijskih pooblastil na organe drugih držav članic ali institucije Evropske unije. Avtorja menita, da bo trend policijskega sodelovanja na ravni Unije šel nadalje v smeri poenostavljanja pravil in pristopa od spodaj navzgor (bottom-up approach), kar bi omogočilo razvoj bolj kvalitetnih instrumentov sodelovanja, kot je bila vzpostavitev Stalnega odbora za operativno sodelovanje na področju notranje varnosti (COSI). Ob pripravi novega večletnega programa za skladen razvoj območja svobode, varnosti in pravosodja pa se poraja vprašanje, koliko pooblastil za zagotavljanje notranje varnosti in ukrepanje bodo države članice nadalje prenašale na Evropsko unijo. Izvirnost/pomembnost prispevka: Poznavanje sistema policijskega sodelovanja v Evropski uniji je zelo pomembno za policiste in strokovnjake s področja kazenskega pravosodja.

Title:Police cooperation mechanisms for the provision of internal security in the European union
Abstract:Purpose: European Union represents the area where the right to security is guaranteed. Many agencies, especially police, are responsible for this area many agencies. The purpose of this paper is to present the instruments of the European Union that are governing the field of police cooperation in the process of ensuring internal security within the European Union. The authors emphasize the importance of police cooperation, and present the legal frameworks, legal measures, instruments and forms of police cooperation at the level of the European Union. The role of Slovenia as the Member States is specifically emphasized. In the end authors discuss the performance of development of police cooperation in Europe. Methods: A literature review of particular strategies, regulations and other acts of the European Union bodies which regulate police cooperation in the European Union. Findings: The police cooperation in the European Union includes a variety of political, legislative, organizational, systemic and operational measures. The development of police cooperation in the past 20 years has gone mainly toward continuous improvement in the exchange of police information and intelligence. On the contrary, the field of transfer of investigative and police powers to the authorities of other Member States or the European Union institutions was neglected. The authors believe that the trend of police cooperation at European Union level will go further in the direction of simplification of rules and a bottom-up approach, which would allow develop a more efficient instruments of cooperation. The establishment of the Standing Committee on operational cooperation on internal security (COSI) is one of promising measures. Faced with the preparation for the new multiannual program for the harmonious development of the area of freedom, security and justice, the question about the nature and intensity of powers are needed to ensure internal security in the European Union. Originality/Value: This contribution is an attempt to depict regulation of police cooperation in the European Union. It is very important for police officers as well as experts in the area of criminal justice to get acquainted with the police cooperation system existing in the European Union.
