Title:Policijsko zbiranje obvestil in zaslišanje osumljenca : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo ugotavljali, kakšna je razlika med institutom policijskega zbiranja obvestil osumljenca in institutom policijskega zaslišanja osumljenca v predkazenskem postopku. V prvem delu diplomske naloge je na kratko definiran predkazenski postopek, za tem je opredeljen pomen testimonialnih dokazov oziroma dokazov, prejetih s pomočjo pričevanj, temu pa sledi definicija in razlaga vabljenja, enega glavnih pooblastil policistov, ki se navezuje na zaslišanje osumljenca. Na koncu tega dela diplomske naloge je opredeljen osredotočen sum, besedna zveza, ki jo policisti uporabijo, ko osebo obravnavajo kot edinega možnega storilca kaznivega dejanja. Da so bile ugotovljene glavne razlike med policijskim zbiranjem obvestil osumljenca in policijskim zaslišanjem osumljenca, sta morali biti ti dve fazi policijskega postopka zakonsko opredeljeni. Tako so v nadaljevanju naloge razloženi normativna ureditev, pravice osumljenca, potek zaslišanja in napake, ki jih policisti naredijo ob zaslišanju, kar lahko privede do izločitve nekaterih dokazov. Nazadnje so bile pregledane odločbe ustavnih sodišč, s čim je bilo na praktičnih primerih preverjeno, kje pristanejo dokumenti, pridobljeni v predkazenskem postopku, kakšno moč imajo za nadaljnji kazenski postopek, voden s strani sodišča in kakšne napake nastanejo v postopku zbiranja dokazov. Ugotovljeno je bilo, da zelo pomembno vlogo v predkazenskem postopku igrajo policisti, ki morajo pri svojem delu biti pozorni, da ne naredijo napak, saj te lahko privedejo do kršitve človekovih pravic in posledično izločitve dokazov, in da obstaja razlika v dokazni vrednosti izjav, glede na navzočnost zagovornika pri zaslišanju.

Title:Police gathering of informations and interrogation of suspect
Abstract:In this thesis we were researching the difference between the institute of police information gathering and police interrogation of suspect in pre-trial proceedings. First part of the diploma paper briefly defines the pre-trial procedure, followed by definition of testimonial evidence or evidence obtained through testimony and definition with interpretation of invitations, which is one of the main police authorizations in interrogation process. At the end of this part of the thesis phrase ’focused suspicion’ is defined as it is commonly used by police officers when treating a person as the only possible offender. In order to identify main differences between police gathering of information and police interrogation of suspect, these two stages of the pre-trial procedure had to be legally defined. Subsequently normative regulation, rights of a suspect, course of the hearing and errors in police interrogation that can lead to exclusion of evidence are explained. Finally, decisions of the constitutional courts have been reviewed, which showcases, based on practical examples, where the documents from pre-trial procedure are being held, what power they have for further criminal proceedings and what errors occur in the process of gathering evidence. It has been discovered that police officers play an important role in pre-trial procedure, however they have to pay attention not to make mistakes, as this can lead to human rights violations which can cause elimination of evidence. It has also been found that a difference in probative value of suspects statement occurs if a counsel is present at the hearing.
