Title:Prispevek sodobnih znanstvenih spoznanj k učinkovitejšemu vodenju kognitivnega intervjuja

Abstract:Namen prispevka: Namen tega prispevka je predstaviti nekatere novejše ugotovitve in znanstvena spoznanja o preiskovalnem intervjuvanju, kot jih uporabljajo v tujini. V prispevku je predstavljena izboljšana različica kognitivnega intervjuja (angl. enhanced cognitive interview – ECI). Gre za eno najbolj znanih in široko uporabljanih tehnik za pridobivanje informacij od kooperativnih prič in žrtev kaznivih dejanj. V Veliki Britaniji je temelj trenutnega modela preiskovalnega intervjuja PEACE, o njem pa se izobražujejo tako na novo zaposleni policisti kot strokovnjaki za izvajanje intervjujev. Opisana je učinkovitost protokola (veljavnost in točnost pridobljenih informacij), prav tako pa tudi usposabljanje, ki vključuje učenje kognitivnih tehnik. Takšno usposabljanje lahko pripomore k boljšemu nastopu, vodenju in izpraševanju prič ter žrtev kaznivih dejanj Metode: Prispevek je nastal na osnovi integrirane sinteze strokovnih, predvsem pa znanstvenih virov, katerih avtorji so vodilni teoretiki in praktiki na področju preiskovalnega intervjuvanja v svetu. Ugotovitve: Kognitivni intervju ostaja ena najboljših praks na tem področju kljub določenim omejitvam, kot so npr. časovna zamudnost, število in kompleksnost razpoložljivih tehnik. Preiskovalni organi potrebujejo poenostavljen in intervjuvancu prijazen protokol, ki vsebuje le preizkušene elemente za izboljšanje spomina ter izvedljiv enoten postopek z manj kognitivne zahtevnosti za izvajalce intervjujev, ki delujejo v vse bolj kompleksnih operativnih okvirih. Pričakujemo lahko, da bo šel razvoj v smeri prilagajanja posameznih tehnik realnim potrebam policije. Izvirnost/pomembnost prispevka: Prispevek je namenjen predvsem strokovni javnosti, preiskovalcem, ki opravljajo informativne pogovore, in vodstvu policije, ki lahko spoznanja iz prispevka upoštevajo pri uvajanju sodobnejših in učinkovitejših modelov intervjujev v preiskovalno prakso. Izsledki poudarjajo pomembnost približanja slovenske prakse tujim znanstvenim spoznanjem predvsem v smislu učinkovitejšega in etično sprejemljivejšega modela intervjuvanja.

Title:The Contribution of Modern Scientific Findings to More Effective Cognitive Interviewing
Abstract:Purpose: The purpose of this paper is to outline some of the recent findings and scientific evidence on investigative interviewing as applied abroad. The paper presents the enhanced version of the cognitive interview (ECI). ECI is one of the best known and most widely used techniques of obtaining information from cooperative witnesses and victims of criminal offences. In the United Kingdom, the CI underpins the current PEACE investigative interview model and is taught to all police recruits and expert interviewers alike. Besides the effectiveness of the protocol (validity and accuracy of obtained information), the aim is to find out whether such training that includes learning cognitive techniques really contributes to better performance, conducting and interviewing of witnesses and victims of criminal offences. Methods: The paper is based on the integrated synthesis of expert, especially scientific sources whose authors are leading theoreticians and practitioners in the global field of cognitive interviewing. Findings: The cognitive interview remains among the best practices in this field despite certain limitations such as lengthiness, number and complexity of available techniques. Law enforcement agencies need a simplified and interviewee-friendly protocol containing only the proven memory-improving techniques and a feasible uniform procedure with less cognitive demand for interviewers who work in increasingly complex operational contexts. We can expect progress towards the adaptation of individual techniques to the real needs of the police. Originality/Value: The paper targets primarily the expert public, investigators performing informative interviews and police leadership that may consider the findings of the paper when introducing more up-to-date and efficient models of interviewing in the investigation practice. The findings emphasise the importance of the approximation of Slovenian practice to foreign scientific findings especially in the sense of a more effective and more ethically acceptable interviewing model.
