Abstract:Kljub skrbnemu poslovanju lahko družba zaide v velike finančne težave. Ena izmed glavnih negativnih značilnosti slovenskega gospodarstva je plačilna nesposobnost oz. plačilna nedisciplina, ki je razlog za začetek stečajnega postopka. Glavni cilji stečajnega postopka so, da so vsi upniki obravnavani enako, da so v čim večjem delu poplačane terjatve upnikov, ter da se po končani unovčitvi premoženja stečajnega dolžnika in razdelitvi stečajne mase insolventen gospodarski subjekt izbriše iz sodnega registra. Celotno premoženje stečajnega dolžnika se unovči v okviru stečajnega postopka, iz tega premoženja se oblikuje stečajna masa. V stečajno maso spada vso premoženje, razen tistega, ki je predmet izločitvene pravice. Iz stečajne mase se po pravilih in vrstnem redu, kot ga določa zakonodaja, poplačajo upniki prezadolženega dolžnika. Pri prodaji premoženja v stečajnem postopku obstajajo tudi posebnosti glede posamezne vrste premoženja. V diplomskem delu je podrobneje prestavljen stečajni postopek in z njim povezana prodaja premoženja oz. stečajne mase.

Title:Sale of assets of the bankruptcy debtorin in bankruptcy
Abstract:Despite careful business, a company can run into big financial problems. One of the main negative features of the Slovenian economy is insolvency resp. payment indiscipline, which is the reason for the start of a bankruptcy process. The main objectives of the bankruptcy process are to treat all creditors equally, to pay off as many creditors' claims as possible and to remove the bankrupt debtor from the court register after the liquidation of the assets and the distribution of the bankruptcy estate. The bankruptcy debtor's entire assets are redeemed in the course of the bankruptcy proceedings, from which the bankruptcy estate is formed. The bankruptcy estate includes all property other than which is the subject of an exclusionary right. According to the rules and in the order prescribed by law, the creditors of the bankruptcy debtor are paid out of the bankruptcy estate. When selling assets in bankruptcy, there are also specificities regarding each type of property. In this Bachelor thesis, the bankruptcy procedure and the related sale of assets resp. bankruptcy estate are detailed.
