Opis:Gre za prvi kazenski primer v Sloveniji, katerega kaznivo dejanje je bilo posneto in »v živo« predvajano na socialnem omrežju Facebook. Nasilni 23-minutni posnetek pretepanja je med Slovenci pritegnil ogromno pozornosti, saj je na spletu vztrajal več kot 13 ur. Čez dan si ga je ogledalo več kot 230 000 ljudi, kar je vzbudilo veliko nastrojenost proti nasilnežema. Žrtev nasilja je dan kasneje v UKC Ljubljana podlegla poškodbam, zaradi česar se je spremenil obtožni predlog iz hude telesne poškodbe v hudo telesno poškodbo s smrtnim izidom. Ker je bil kazenski primer zaradi svoje narave zelo poseben, je bil med sodno preiskavo prisoten v vseh medijih, ki so javnost informirali o spremembah samega primera. Po štirih mesecih sodne preiskave je tožilstvo obtožnico prekvalificiralo v umor, ta pa je ostala nespremenjena do sojenja. Nasilneža sta bila za storjeno dejanje obsojena na zaporno kazen nad 20 let, kar je za slovenske razmere sorazmerno visoka kazen, njuna zagovornika sta za to obtoževala medije, ki bi naj s svojim delom izvrševati posredni pritisk na javnost. Kljub pritožbam obrambe, da je za prekvalificirano obtožnico v postopku in končno izrečeno kazen Okrožnega sodišča v Krškem kriva javnost in njihovi pritiski, tega na Višjem sodišču v Ljubljani niso uvideli. V diplomski nalogi smo zato naredili analizo in preučili, kakšen je lahko vpliv medijev in posledično pritisk javnosti na odločitev o višini izrečene kazni, ter ali je zaradi objavljenega posnetka na spletu to pomenilo nedopusten pritisk na odločitev sodišča. Preverili smo tudi, ali je bil posnetek zaradi instituta privilegija zoper samoobtožbo sploh dopusten dokaz na sodišču ter pojasnili, kakšna je razlika med prvo bremenjeno obtožnico in kasnejšo prekvalificirano, ki ju je bremenila umora. Postavili smo si (nam) zelo pomembno vprašanje, ali/če bi se v samem primeru kaj spremenilo, če nasilneža posnetka ne bi objavila na Facebooku in se uporabniki Facebooka oziroma javnost ne bi neposredno seznanili s samim kaznivim dejanjem oziroma početjem.

Opis:The following degree paper discusses, the first criminal case in Slovenia that had been recorded and broadcasted live on social media, more precisely Facebook is being discussed. The violent tape had lasted for 23 minutes and was available online for watching for 13 hours. Consequently, it has attracted a lot of attention among Slovenian population. The video had been watched by more than 230 thousand people. A negative stance towards suspects had been spread. The victim had died a day later in UKC (University Medical Centre) Ljubljana. Due to his death the proposition about charge sheet had been alternated from major physical injury to physical injury, that turned out to be fatal. The case had been resonating in the media, due to its specific nature. Media had been releasing information about every bit of progress regarding the case. After four months of the judicial investigation the prosecution had retrained the indictment to murder. This remained unchanged until the trial. The suspects had been charged with over 20 years of prison sentence. The advocates had accused media for the high penalty. According to advocates media had performed indirect pressure from the public. The defence had been warning that the overqualified indictment and the final penalty had been a consequence to public pressure on the District court in Krško. This had not been acknowledged by The Higher court in Ljubljana. In degree paper we have analysed the influence the media and public might had had on the decision about the penalty. We have also discussed potential reason (broadcasted video online) that might had influenced the court´s decision that ought to be objective. We also discussed whether the video was permissible evidence against self-conviction regarding the institute of privilege. The difference between first indictment and latter requalified one is being discussed in the paper. In the paper we question whether the result of the case would be different, if the convicts had not broadcasted the video and there was not any public and media pressure.
